C&R out of state transfer question

    C&R out of state transfer question

    My question is if I have my valid 03FFL and COE, can a private party out of state ship directly to me or do they have to use the CLFC system? Along that line must they use an FFL to ship it to me or can they ship it directly? The fire arm in question is a Swedish Mauser so it fits the C&R guidelines. Comments are much appreciated.

    If it is a C&R long gun they can ship it directly to you.
    03 FFL's are exempt from the CLFC program.

      CLFC system does not apply to valid 03-FFL holders.

      Since you have a valid 03-FFL and valid COE, an out-of-state party (private or FFL) can ship a C&R long gun directly to you.

      Once it arrives, you will need to log it into your bound book and, within 30 days of receiving the C&R long gun, you must report it to CA DOJ by submitting a completed Collector In-State Acquisition of Curio or Relic Long Gun Report.



      Penal Code 27966
      Commencing January 1, 2014, if all of the following requirements are satisfied, Section 27545 shall not apply to the sale, loan, or transfer of a firearm:
      (a) The sale, loan, or transfer is infrequent, as defined in Section 16730.
      (b) The firearm is not a handgun.
      (c) The firearm is a curio or relic, as defined in Section 478.11 of Title 27 of the Code of Federal Regulations, or its successor.
      (d) The person receiving the firearm has a current certificate of eligibility issued pursuant to Section 26710.
      (e) The person receiving the firearm is licensed as a collector pursuant to Chapter 44 of Title 18 of the United States Code and the regulations issued thereto.
      (f) Within 30 days of taking possession of the firearm, the person to whom it is transferred shall forward by prepaid mail, or deliver in person to the Department of Justice, a report that includes information concerning the individual taking possession of the firearm, how title was obtained and from whom, and a description of the firearm in question. The report forms that individuals complete pursuant to this section shall be provided to them by the department.

        Thank you for the link and the Penal Code 27966. I thought it was 5 days but that clears that up. I noticed there were to forms on DOJ site. Bof 4100a and BOF 961. I was not sure which one was right for an out of state transaction.

          30 days, if you acquire when you are physically in CA. (BOF 961)

          5 days, upon returning to CA, if you acquire it when you are physically in another State. (BOF 4100A)

              can someone confirm this for me?
              i think the rules above sum up to this, but would like a double-check.

              even if the buyer is a FFL03, C&R handguns purchased from out-of-state coming into California still have to be transfered with a FFL-01

                You mean shipped from out of state, yes, must go to an 01 FFL

                If you are physically out of the state, and have an 03 FFL, you can buy them and register them when you bring them across the California Frontier.
