    Can I Still Use a C&R?

    Hello everyone,

    I have been collecting a lot of my milsurp collection by using my C&R for the past year. However I have stopped adding milsurp guns to the collection because of that new law passed on July 1st. To my understanding it means I cannot buy a C&R weapon from out of state unless I get additional paper work from the ATF.

    Now, my problem is that right after July 1st I was in North Carolina and bought a Enfield thinking I could just use my C&R and have the guy mail it to me. But when I got back I learned of the new law and have had the rifle on hold ever since.

    Is there a way I could just have the guy ship me the rifle? He isn't a dealer and only sold it to me because my uncle who I was visiting is a good friend of his.

    So what can I do?

    the law you are thinking of is the CFLC, and as an 03 FFL, you are exempt from it. And if the seller is either an 03 or non-licensed individual, it doesn't apply either. It is a CA law, not federal, no ATF involved in it.



    You can have the seller ship it directly to you, as an unlicensed individual, the CFLC doesn't apply, and you as an 03 FFL, the CFLC doesn't apply.


    also, too late now, but you do know that you could have legally taken possession of the rifle in NC and then either brought it back with you, or shipped it to yourself?

      Thank you very much for that information.

      Now, I always thought there was a difference between a C&R FFL and a 03 FFL.

      But I am glad to know I can just have him ship it to me.

      Also, I would of had it shipped but I did not have the C&R with me.

        He can ship it to you and an (out of state) FFL dealer can ship it to you. But an (out of state) FFL dealer can not ship to a CA FFL dealer without using the CFLC system.

          Thanks again everyone,

          But since this is a law and I do not want this gentleman to get into trouble I just want to make sure I am 100% clear on the rules.

          So...

          As long as I have a C&R FFL license I can still get Curio and Relic rifles shipped to me. But if I had to have a dealer do it like a gunshop the dealer would have to go through the whole CFLC system.

          Am I correct?

          Also, does this mean I can start doing business with AIM and J&G Sales again? They have some good deals I am dying to jump on.

            AS a C&R 03 FFL, you are exempt from the CFLC. That means that anybody, private citizen or FFL can ship C&R long guns to you without a CFLC verification.

            AIM and J&G should be able to ship C&R long guns directly to you, no instate FFL or CFLC verification needed. Wether or not they are up to speed on the CFLC, I dunno.

                  California Firearms Licensee Check System (CFLC)

                  As of July 1, 2008, California Penal Code Section 12072(f)(1) [PDF 30 kb / 1 pg] prohibits all Federal Firearms Licensees (FFLs), other than Type 03 or 06 FFLs, from shipping firearms to an FFL in California unless, prior to delivery, the FFL intending to deliver, sell or transfer the firearms obtains a verification approval number from the California Department of Justice (CADOJ) Bureau of Firearms. This includes transfers that occur at gun shows.

                  The verification approval number, which the Bureau of Firearms provides in a Firearms Shipment Approval letter, confirms that the intended recipient of the firearm shipment is properly licensed and listed in the state's database of persons/entities authorized to receive firearm shipments. If the intended CA FFL recipient is not listed in the state's database, the transaction will result in a Do Not Ship letter, and it is a crime for the intended recipient to receive the firearms (Penal Code Section 12083(c)(1)).

                    Yes, you can get guns directly to your door from AIM and J&G using your C&R. C&R is exempt from the CFLC. If you were using a FFL01 to purchase the rifle(s), then that 01 would have to have the seller register with the CFLC.

                    So the 03 pays off (well not counting the chickens who won't sell anything to CA at all or anything to CA C&R holders but we can't do much about people who are afraid to even make a legal transaction).

                      As a 03 FFL holder (C&R), this law does not apply to you. A private party, 03 FFL holder or 01 FFL holder (dealer) can ship to you. The CFLC only applies to transfers between 01 to 01 FFLs

                          when this law went into effect alot of dealers out of state made up their minds that they will not sell anything to us here. when you find a good deal and the seller is willing to ship here, it is in your destiny to buy it.
