    C&R Question (10-day waiting period)

    So now that a Federal judge has declared CA's 10-day waiting period unconstitutional, how is that going to affect C&R gun purchases?

    Also - I wonder stores like Big 5 have gotten the message yet?

    They have 180 days to rewrite the law. They can still come up with something that will make it difficult. UNTIL IT IS LAW, it is not in effect.

        But even so, AFAIK there's no provision/exclusion/accounting for C&R guns. In other words (experts please correct me if I'm wrong), even if this ruling does become law, C&R status is irrelevant.

          As of today, if you have your FFL03 + COE, there is technically supposed to not be any waiting period to take home C&Rs but as we know from the lawsuit, Kamala and her goons need to be sued to honor this part of the law anyway.

            I have bought multiple C&R firearms, and have been able to "cash-and-carry" them from the FFL (Turners). The DROS was submitted but I left immediately with the firearm on each occasion.

            I haven't heard about them not honoring that exemption anymore.

              so does this mean we can go back to FTF sales w/out COE?

              would love a link to the news story/ruling.

                  Wow, you must have an enlightened Turners near you. Where I live, I have only been able to find one dealer who let you take a C&R with no wait, but he is an educated FFL01 and knows the ins and outs. Big 5 certainly wouldn't let me, two other locals wouldn't either, they were all clueless about what an FFL03 and COE even were. When I showed them the PC, they just shrugged it off with a "sorry". I thought there was a lawsuit against Kamala/CADOJ because they weren't letting people take their C&Rs home without the ten day wait? Or was the lawsuit only against them coming down on FFL01s for the 1 in 30 rule?

                    they weren't sure how to do it, the salesperson was on the phone with someone at the corporate office the whole time to walk him through the steps.

                    it was the most enjoyable time I ever had buying a handgun in CA.

                    once I decided I was going to buy one (it was a C&R P-64 that they had on sale for cheap).

                    he had me look at one and I liked THAT one so he goes to put it back in the case and I told him, "No, I want that one". OK, so he asks me if I have my DL and stuff, so I dig it out along with my 03 and COE. He hands me a 4473, I told him I didn't need one since it is an FFL > FFL transfer. he argues that they need it, so I go ahead and fill one out anyways. somewhere aroudn this point, I think I got handed off to a manager since the salesperson was way over his head. I gets asked for PoR, I tell him the 03 I handed him is proof. He then asks for my HSC, I tell him my 03+COE exempts me from that. he then tells me he needs to sell me a lock. I tell him that the Safe Affidavit is acceptable because I am exempt from the federal handgun lock law as an 03 buying a C&R handgun so I only need to satisfy CA law. there was one or two other things I had to correct him on that he confirmed with the guy on the phone.

                    Then, I am handed my paperwork to pay for it up front. I go up there and pay the girl. she goes to file the paperwork like they do 99.999% of the time, but I tell her I need the paperwork back to take to the gun counter. I get the paperwork back and head back to the gun counter. I had the paperwork back to the salesman and you can tell that he is still not comfortable about this. You see, in normal Turners operation, once the paperwork is at the cashier, they will self-audit during the 10-day wait to check for any errors before the customer comes back into the store, and with me short-cutting the process, they didn't get to do that.

                    I ended up spending around $200 for that gun, which I have never shot and is buried in my safe, just so that I could fee like I lived in a free state and could cash-and-carry (even tough they did still DROS me, I got to walk out immediately).

                      I believe the lawsuit was over C&R FFL + COE and the 1 in 30 day wait.

                        I'm waiting on 10 day wait for a C&R long gun DROS despite my having an 03FFL & COE. I made the mistake of going in a store that had something I really wanted and it was under priced... so although I wanted to tell them to pound sand, the low price made it worth the wait. Oh well.

                          That's awesome! I've only used my FFL03+COE when the 1 in 30 exception worked. Walking out with a firearm day of purchase must feel nice!
