Confused about FFL 3

    Confused about FFL 3

    I thought cash and carry for C&R went away after January 1st. Why do I still see people offering this in the Calguns marketplace? There is an ad for Mosins right now saying show your FFL 3 and COE and walk away. I have seen other ads saying the same. Please enlighten me.

    Cash and carry for a C&R rifle / shotgun over 50 yrs old between 2 CA residents was legal regardless of having an 03 FFL but that ended on 1/1/2014. However having an 03 FFL and a CA COE now allows one to buy any c&r long gun ( regardless of age ) face to face But the buyer has to register it but sending a form with $19 fee to DOJ..

      If you have an 03 + COE, you can buy C&R FTF, cash and carry. You have to self-register and pay a $19 fee, as well.
      You will never, in your life, have a chance like this again.
      If I were you, I would not pass this up. I would not let this go by...this is rare.
      Come on...what harm??

        if the buyer has an 03+COE, then they can cash and carry from the seller. The buyer is supposed to report the purchase to CADOJ, but that happens after the sale. there is no need to do a PPT through a dealer if the buyer has the 03+COE combo.

          The above responses are correct.

          Here's the CA law on the matter...

          Penal Code 27966
          Commencing January 1, 2014, if all of the following requirements are satisfied, Section 27545 shall not apply to the sale, loan, or transfer of a firearm:
          (a) The sale, loan, or transfer is infrequent, as defined in Section 16730.
          (b) The firearm is not a handgun.
          (c) The firearm is a curio or relic, as defined in Section 478.11 of Title 27 of the Code of Federal Regulations, or its successor.
          (d) The person receiving the firearm has a current certificate of eligibility issued pursuant to Section 26710.
          (e) The person receiving the firearm is licensed as a collector pursuant to Chapter 44 of Title 18 of the United States Code and the regulations issued thereto.
          (f) Within 30 days of taking possession of the firearm, the person to whom it is transferred shall forward by prepaid mail, or deliver in person to the Department of Justice, a report that includes information concerning the individual taking possession of the firearm, how title was obtained and from whom, and a description of the firearm in question. The report forms that individuals complete pursuant to this section shall be provided to them by the department.

            Cool. I thought it went away all together. I sent my application in last week. This makes it even better. I thought it was only good out of state.

              But if I buy in an LGS I have to do transfer but no 10 day wait? (After I get the FFL 3 and COE)

                Yes, but some FFL's do not honor the 10 day wait exemption.

                  Educate them. In the new DES system it's easy as it is just a drop down menu and easy to do.
