    C&R Cash and Carry Question

    Sorry if this is has been covered before but searching didn't yield any results. I saw a Mosin Nagant 91/30 at Big 5 tonight that i was considering buying. I do not have any sort of FFL or COE, however i thought these guns required no 10 day wait and could be purchased "cash and carry." The salesperson told me that rule only applies to FFLs. I didn't know nearly enough to debate it but looking through the threads I can't tell if that rule only applies to FTF and not dealer sales. Can someone wiser than I help? Thanks

    Cash and carry of a C&R rifle, can only be done between two persons face to face, unless you have the proper FFL.
    So in your case(you do not have an 03), buying from an FFL like Big 5, is no different than buying any other rifle.

          Longguns 50 years and older are exempt from being transferred at an FFL until Jan 1st 2014.

          Purchasing them from an FFL in CA still requires DROS and the 10 24 hour wait period.
          Unless you are an FFL03 with a COE in that case DROS is still done but there is no wait.

              Long gun over 50 years old can be mailed in state from one Ca resident to another Ca resident providing its legal for both to own correct?

                CA legal to do so until 12-31-2013.

                Starting 01-01-2014, it would be illegal to do so. Because cash & carry transfers of C&R long guns will only apply to people with valid C&R FFLs & COEs.

                  So if I find a private party selling a Mosin, I can buy it directly from them, no FFL needed? Im so confused about this. What other rifles qualify for this rule??

                    Yes, as long as you're over 18 and not a prohibited person. Any C&R long gun qualifies; K98, 1903, 1903A3, M1 Garand, M1 Carbine, 50 year-old hunting rifle, etc.
