    Just wondering...

    I have a Federal Curio and relic license, and travel to California a lot to visit friends and family. If I happen to walk into a gun store or pawn shop in California and see a Curio and Relic firearm that I want, could I buy it ? Do I have to wait 10 days? ( That would most likely be longer than my vacation!)
    Always carry a copy of my FFL just in case.

    I'm not an expert in this area. I think you cannot.
    A CA resident with both a C&R plus a CA COE can purchase and take immediate possession. A DROS is still done.

    The two issues I see are:
    1) You do not have a COE.
    2) Your out of state ID probably cannot be accepted by the CA dealer.

      Out of state resident C&R FFLs are exempt from the DROS and 10 day wait when buying C&R firearms in California. However, many gun shops are completely unaware of this exemption, so you might not have any luck.

        I've done it, but the California ffl wanted to see no only the -03 license (I had to tell him he needed an original-signed copy, which I left with him), my Idaho DL, and for reasons unknown to me, my Idaho CWP.

        After hemming and hawing, I walked out with guns.

        PITA, but a good deal.

          My experience is very inconsistent. Some gunshops are knowledgeable and good to deal with. Others are wary and don't want you to take possession at the store but will ship to the address on your 03. And then there are the hostile or ignorant shops which include some who can only be described as hateful liars.

          Ask, you might be pleasantly surprised.

            The DROS exemption for sales to out of state FFLs is CPC 28100(b)(4)
            The 10 day waiting period and HSC exemption is CPC 27715

            Showing those to the selling dealer might help convince him. But like VegalND said, it will just piss off some dealers because they'll think you are being too much of a smarty pants in their shop. Other's will want the specific question answered in writing by somebody at CalDOJ.

            On a related note, out of state C&R FFLs can also acquire C&R firearms (long guns and handguns) directly from private parties or other C&R FFLs in California without having to use a dealer. The exemption for this is CPC 27895.

            That might have been his way of verifying that you were an out of state resident. He was doing the whole "ID plus second document for proof of residency" thing that California requires for regular handgun sales. The DROS and waiting period exemptions require that the buying FFL actually be a resident of another State and not just have an FFL in another State. But then a C&R FFL counts as a second document for proof of residency, so maybe he was just being extra careful.

              Wow, Thanks for the info. That opens a whole new outlet for guns, only if the seller knows the law. Don't want to get in an argument with any seller over this...will just walk away. Does this apply to gunshows too? Guess a lot at gunshows are private party sales. Never been to any in California for this reason...10 day wait. The one at the Cow Palace always sounds interesting.
