    C&R Private parties?

    Am I reading this right? For C&R sells between private parties of legitimate C&R guns older than 50 years old there is no need to do a transfer through an FFL? No DROS? Walk in, pay for the gun, walk out? Seems weird for California... this is why I am double checking.

    For a very narrow range of firearms, no dealer or license is required. An individual can purchase Curio or Relic long guns without using an FFL and with or without having a Curio and Relic/03 Federal License themselves.

    California uses the Federal definition of C&R guns Penal Code 27965 (was 12078(t)(2))

    (a) If all of the following requirements are satisfied,
    Section 27545 does not apply to the sale, loan, or transfer of a
    firearm:
    (1) The sale, loan, or transfer is infrequent, as defined in
    Section 16730.
    (2) The firearm is not a handgun.
    (3) The firearm is a curio or relic manufactured at least 50 years
    prior to the current date but is not a replica, as defined in
    Section 478.11 of Title 27 of the Code of Federal Regulations, or
    its successor.
    (b) This section shall remain in effect only until January 1,
    2014, and as of that date is repealed, unless a later enacted
    statute, that is enacted before January 1, 2014, deletes or extends
    that date.


    Penal Code 27545 requires 2 non-licensed individuals to use an FFL in a Penal Code 12082 Private Party Transfer; the above is an exception to that requirement.

    Enjoy it while it lasts. Next year you need to DROS or self register if you are doing a FTF w/license to licence xfr.

      It is legal to purchase/sell a C&R rifle or shotgun that is at least 50 years old without going through a California Licensed Dealer.

      This exemption only applies if neither party is a California Licensed Dealer.For instance two unlicensed Californian's can do a cash and carry transaction of a 50 year old C&R long gun, two California C&R FFL's can do a cash and carry transaction of a 50 year old C&R long gun, and a California C&R FFL can do a cash and carry transaction of a 50 year old C&R long gun with an unlicensed Californian. But if a California Licensed Dealer is selling the gun then the DROS process needs to be completed no matter if the buyer is a C&R FFL or not.

      If the seller is not a C&R FFL then he can only transfer the gun to another California resident. If the seller is a C&R FFL then he can transfer it to an unlicensed out of state resident as long as the transfer takes place at the California C&R FFL's licensed premises and the transaction is legal in the buyer's State too, or he can transfer it to an out of State C&R FFL at any location.

          Don't think so singular - you save money buying in bulk, and Mosins are social creatures.

            ... I do like my current Mosin and I do like Costco. Now to get a little extra spending cash on the side.
