    C&R audit questions

    I'm thinking of getting an 03 FFL.

    I read that they are allowed 1 audit per year, and I'm curious if they are just checking to make sure your buy/sales records match your collection or if they are also running background checks on your buyers.

    Has anyone been audited here? The idea of the ATF being able to visit my house to check items feels a bit...unsettling.

    The license is definitely tempting since I have a lot of nice buys I'm interested in.

    They don't run checks on your buyers. What would that prove? You can't run checks on your buyers.

    My understanding is you can actually do the audit at their offices if you prefer to keep them out of your house.

      They have visited me once. The lady was very nice and cordial. She just checked my book and actually gave me a couple pointers of how to record the entries better. She also brought a bunch of literature about updated laws and other miscellaneous items. They get in contact with you before they come over.

        My FFL expires next February, I'm thinking of not renewing, both so that I can discard my records and because I believe finding dealers that will ship to us (even with the COE) will be tough.

          They check your bound book...as was posted above, an -03 cannot run a background check, so why would the BATFEM require a licensee to do so?

          You are able to have the audit take place at your location or the local BATFEM office. Not sure why you feel " a bit unsettling"...if you're unsettled, don't apply for the license.

          I was audited years ago by the DFW branch. Brought my paperwork to their office...5 minutes of checking paperwork (20 or so transactions), 90 minutes shooting the crap about guns.

            they tried on me when i was 22, it was the new chick they hired back in 07. I took the option of forfeiting my ffl as I was on vacation and it seemed like a ****show, which im sure it is. I never got an option to have the audit on their property. they wanted a safe inspection! HAHAHHAHA

                I've had mine for coming up on six years, never been audited. For those that have how were you notified? Mail? Phone? Knock on the door? Just curious.

                    When I got my 03 in March I always thought f that....they not coming to my house ..ill go there. I think I would have to rent a trailer now...guess its a meeting in my garage now.

                      They had my old phone number which didn't work so the lady stopped by. She was nice about it though and asked if it was a good time or I wanted her to come back some different time.

                        Not exactly, when BATF audited me 3 years ago they were adamant about doing it onsite to review the collection and A&D Book. I have no issues about an audit as I always keep thinks legal. Before the BATF Agent arrived I had reviewed my A&D Book and layed out all C&R firearms I had aquired after getting the 03 FFL.
                        He arrived and gave me the canned lecture about C&R firearms at which time I debated his information on a couple of points. He called his Supervisor who confirmed I was correct in my information. He asked about how many Acquistions and Dispositions, to determine if I was running a business, I'm sure. We reviewed all the C&R firearms listed in the book as aquired and not disposed of saw that everything matched up. He suggested I keep a separate record of ALL firearms in my possession, C&R owned "before" I got the C&R FFL and any modern ( as some will become C&R at sometime) or antique firearms. As he left he said and I quote, "Seems you know more about the C&R Laws than I do, don't expect me back anytime soon".

                        He arrived in an unmarked car so your neighbors will never know the BATF is at your place.

                            This is a good idea.

                            To the OP: You could also get the license and buy all the guns you want, say in the first year, then surrender the license (write cancel on it and send it back to BATFE certified mail) at which point you would be free from any "requirements/regulations" with respect to the license. You also have to figure that with the huge influx in 03FFL's in the last few years the odds are slim that you'd get picked out of the hat.

                              Clever!! Someone other than myself said this would work even if you had (for long guns only not 01 or self registration) due to the fact that the dealer records aren't reported and basically sit in a binder at the seller location. What are the odds of them going to a place like Century and back tracking through the records? Slim to none. Of course this ends in 2014 with the long gun self registration (read: computer indexed records). They passed this to specifically have you help them keep better and easily accessible records with regard to c&R long guns.
