A friends dad called yesterday to ask me a couple of questions. He took a 92 winchester in to a shop to see if it was safe to shoot. When he went back to pick it up the shop wont return it without registration. Now I wasnt there so I dont know exactly what was said, But Ive never had to register a long gun. Or he could be confused and they are asking for a NICS? Hes in his 80s. I have only dealt with Factory repair centers in the last 20 years So What should he expext to have to do to retrive his gun? Thanks DR

Gunsmith returning a gun?
Tags: None -
no registration necessary for a rifle (provided it is not an AW, which a lever-action 92 wouldn't be) to be returned to the owner.
27705. Section 27540 does not apply to the delivery of a firearm to
a gunsmith for service or repair, or to the return of the firearm to
its owner by the gunsmith, or to the delivery of a firearm by a
gunsmith to a person licensed pursuant to Chapter 44 (commencing with
Section 921) of Title 18 of the United States Code for service or
repair and the return of the firearm to the gunsmith.Jack

Would it require DROS, or NICS checks? I cant think that Ive ever had to do anything to retrive a gun. thanks for the quick reply. DRComment

The quoted section about is in regards to the DROS process, so no, it does not need a DROS submitted or anything when being returned from a gunsmith if it is returned to the person who sent/brought it in.Kemasa.

Before I get jumped...
I am in favor of repealing all firearms laws since 1773, okay. Now…
There are all kinds of reasons to re –DROS a long gun;
How long was the gun in for repairs? Did the guy say to someone that the gun actually didn’t belong to him? Did the owner act confused & disoriented, or say something stupid like suicide or getting even with someone? How about becoming a prohibited person in the interim?
I’d like to know the truth, but what is the GS going to do? They can’t discuss individual cases on public forums.
Whatever the facts, I’d sure like to see the issue is resolved. If, if it is the result of an over-zealous gun clerk ….Again, facts, get it all straight and go shooting.
