    Cash and Carry Confusion

    so i have a 1942 Mosin nagant im trying to sell...can i just FTF sell this without an FFL?....i dont have a FF03 C&R license...whats the dealio?

    You can sell it face to face (no FFL) in state to someone who isn't prohibited from owning firearms.

      hmm...how would one know if someone is prohibited....just trying to protect myself here

        Technically, you only need to not have knowledge or reason to suspect that they are prohibited. You don't need proof that they aren't prohibited.

        But for age you really do need to know that they are at least 18 years old. So if they look young you should check their ID.

        You also need to make sure they are a California resident if they aren't an FFL.

            great question, how about if you bought it and dros it, can you sell later face to face?

              i would also like to know this.....ive read that FFL are FFL01 so they have to dros it....

                I would have any FTF purchaser bring me a photocopy of his driver's license and tell me that he is not a prohibited person. Whether or not the gun had DROS paperwork done when you bought it doesn't necessarily mean you are required to DROS it when you sell it.

                  Yes. It doesn't matter how you obtained beforehand.
                  As long as it's a 50+ year old C&R long gun, you're gtg... (at least until Jan 1st, 2014)

                  ANY firearm bought through a dealer needs to be DROS'd. Even if you hold an 03 C&R FFL and you buy it from an 01 FFL, you still have to DROS it and go through the 10 day ban. If you hold an 03 FFL + COE, (Certificate of Eligibility) you can bypass the 10 day ban, but again, it would still need to be DROS'd if going through a dealer.

                  The exception is, an 03 FFL holder buying a 50+ year old C&R long gun from an 01 FFL out-of-state can have it shipped directly.

                      Yes you can sell it ftf and remember the state doesnt keep records (yet) on long guns so it really isnt registered to you.
