    Cash and Carry Question

    qq - I'm thinking about selling my K98 mauser, but I am unclear how Cash and Carry works if I am the seller.

    Does one of the party need a C&R license or can the cash and carry be done between two private parties (w/o a C&R) since the rifle is an antique?

        Your K98 wouldn't be an antique since it was first created and designed in 1934, based off the Gewehr 98 which was first designed in 1898.
        It is a Curio & Relic.

        Nevertheless C&C is fine, if you the seller AND the buyer are both CA residents. The buyer as of current, need not to hold an 03 FFL but must be 18+ years of age and is not prohibited from purchasing or possessing a firearm. You as the seller, while not required but a good idea to have, is write up a bill of sale.

          Well, unless the rifle was made on or before 1898 (that was the cutoff, correct?) it's not "antique" but if it's over 50 years old it is C&R. As a general rule across the country, private sales of all non-NFA firearms are legal pending state laws. Our state saw fit to prohibit the private sale of modern firearms, but didn't ban the private sale of C&R long guns, which as far as I am aware is still legal so long as both parties are CA residents and neither is prohibited from possessing firearms.

            thanks for the replies guys and the pdf BoS (good idea). I've been on the buyer side a few times, but not the seller side so this clears it up.
