any reason why this is not california legal or C&R. Its a pistol, its semiauto and originally built in 1943.

Don't confuse the Federal or CA C&R laws with machine guns, even though some machine guns are on the ATF C&R list. A citizen (non Dealer/LE) legal machine gun had to have been registered during it's original manufacture, if DEWATED (DEactivated WAr Trophy) with papers in the 1940's-1950's, legally imported before the 1968 GCA, 1968 Amnesty registered tax free, or registered and manufactured by a citizen before the 5/19/1986 FOPA ban. C&R guns have to be in their original configuration. As the PPS-43 is foregin, it had to be imported before 1968. Very few were. Most transferable ones are either REWATTED (a DEWAT made live with a $200 tax), 1968 Amnesty registered or a pre 1986 gun built from a parts set. A REWATTED or post 1968 built gun is not original & can't be a C&R machine gun.
NFA laws come first, then the C&R regulations. CA has not allowed regular citizens to own machine guns since at least the late 1960's.Comment

They can be made as fixed mag. River City Gun Exchange has them, I bought one a few months back. The mag release cover is kind of tough to describe - kind of a "U" shaped collar with an opening in the back that slides horizontally over the mag housing and set screwed in place. It's a PITA to use because the mag release has wings, isn't a solid piece of metal, and you have to press the tip of your BB device against that skinny edge to pop out the mag. I bought mine a few months back, used it a few times in OR with the 36 round mags and no BB - it sure does put out alot of rounds and is fun. But in CA with the 10 round mags and difficult to use mag release it loses a bit. Good news is that when I went to put it on consignment as soon as I whipped it out there were 3 guys doing the "How much, I want ...." bit and the gun store was nice enough to allow us to do a PPT instead of consignment.
