    I don't get it. What if you put primer on end of shell first?



    What if you put primer on end of shell first, then loaded the shell into the breach? Would it be illegal to have a row of pre-primed shells on your belt and one of these units in your hands?

    Would a normal break action shotty that takes standard shotty shells be illegal in CA or USA with "pistol length" barrel and short overall length?

    What shell?

    The primer goes on the breach plug for those black powder firearms.

    To load the AGS Diablo/Desperado black powder pistol:
    1. Muzzle load black powder charge (pellet or loose powder) into barrel.
    2. Muzzle load payload (bullet in plastic sabot or bullet with wad or loose shot with wad) into barrel.
    3. Break open the action and load primer onto the breach plug, then close the action.

    The AGS Diablo/Desperado muzzle loading black powder pistol is CA legal because it is considered an "antique firearm".

    If they used shotguns shells, then they would be illegal in CA due to being considered SBS.


    Under CA laws...

    Because it is a blackpowder muzzle loading firearm, it is considered an "antique firearm" under CA laws. [PC 16170(b)]
    Because it uses a breech plug primer ignition system (which is similar to a percussion cap ignition system) it is also an "antique firearm" that is exempt from CA generally prohibited weapons laws. [PC 16170(c)(1)]
    Therefore, CA SBS laws does not apply to the AGS Diablo/Desperado pistol because it is a muzzle loading black powder firearm.

    Because it is a muzzle loading black powder firearm, in order to be considered "loaded" the must be a powder charge and bullet/shot in the barrel and a primer on the breach plug. [PC 16840(b)(2)]
    If it has a powder charge and a bullet/shot in the barrel and no primer on the breach plug, then it is not considered "loaded".

    Unloaded "antique firearms" are exempt from CA unloaded open carry laws. [PC 16520(d)(7),(8)]
