San Jose CLEO?

Hello folks. I'm pretty new to this forum, and new to C&R. I'm filling out my application, and planning on sending it in in the next couple of days, but I have a question about the chief LEO in San Jose. I called SJPD (Chief's office, actually) and got xferred around a few times until I landed with Sgt. Shuper, in the Permits Unit. He's the only one that sounded like he knew what I was talking about, and said to send ti to the Permits Unit, c/o Sgt. Shuper. I'm in no way saying I don't believe him, but I just want to see if anyone else around here has done the same. The form does state "The CLEO is the Chief of Police, the Sherrif, or an equivalent officer, or the designee of such individual."

I just want to make sure:
1. I am sending it to the correct individual, and
2. I am not sending it to the wrong department

There's a difference between those. I'm not a paranoid person, nor a particularly government conspiracy type, but I consider my hobby to be the kind of thing that only some folks need to know about.

Anyway- Any input is appreciated.

Address the Envelope to Him

What they do with it is not your concern, you fulfilled your requirement

When I applied for my C&R FFL I took it in to the police headquarters and they were not sure what to do with it. finally got it in to the main section and they accepted it. When I renew I will just mail it in to the Office of the Chief of Police.

OK. I was mostly just concerned that it was supposed to go to SJPD, not the Sherrif.

It does go to the sheriff. she is CLEO for Santa Clara County.

OK, I called the sheriff's office, and they said she's the CLEO as well. I got a much more certain response out of the Sheriff's office, so they win.

Realistically, has this ever held up an application?

Doubtful, I don't think anybody really follows up on this. It's kinda like an honor system.

It's not really an approval thing, AFAIK, just a notification thing. You have to let them know, but the BATFE isn't waiting for a response before issuing your C&R. And yes, the sheriff is the right contact.

BTW- do a lot of C&R folks around here also get a COE?

From what I've noted, most people do not have a COE... we (C&R only holders) generally just shop outside of CA; via Internet sites; jump on plane tour in the United States - buy all C&R firearms possible to buy in 1 trip and then return to PRK.

BTW, if you live in the City of San Jose; the CLEO is the SJPD cheif. So I hope your application gets handled properly.

As I understand it, the filing with the police chief is a notification, not an application. The chief can't say "No", "You must also do X", etc. Whether he likes it or not, you get your C&R.

Whether or not he gets it or understands it or likes or dislikes it is irrelevant, it's just that you filed it. Send your letter/copy to the chief registered mail and keep the receipt and a copy of what you sent. You're done.

Bill you are sorta correct...

The ATF will send 2 forms (almost a copy of each other) - one goes to the ATF (the "application" as you called it), and the other goes to the CLEO (the "notification" as you called it).

However, the "notification" to the CLEO; is more than a simple notification; as it allows the CLEO to advise the ATF - if there is any reason you are not allowed for any reason (convictions, lack of mental stability, local ordinances, state laws, etc...) - to get your FFL03 via the ATF. So in effect - they can say "NO" - but they need a valid reason.

Anyway... When I did my own license (after some searching); I used the SJPD - as the SJPD - has authority over the city of San Jose, the Santa Clara Sheriff's Department does not.

So the only reason I said "... So I hope your application gets handled properly...", is that the possibility exists that the ATF may reject the application; if the wrong CLEO was "notified".

Hopefully this is nothing to worry about... The form does say the Sheriff is ok... and Cranium got the "ok" from the Sheriff's department...

So... Cranium, let us know how this plays out - if you'd be so kind.

The sheriff's department was very clear in stating she was, in fact, the CLEO. SJPD didn't seem to have confidence to that end.

Since I just know everyone's been on the edge of their seats for this one...
I got my license today!
I'm excited, even though it's come AFTER 10 days in Nevada and 6 days in Utah.
So, I signed it and made a bunch of copies to send out.
But not in that order.
Now to plan the year's family trips. Middletown, OH. isn't too far from my hometown, so maybe a trip is in order.
But how to get the wife to sign on for Prescott, Az.?
