C&R Bound Book Question

    C&R Bound Book Question

    So I just bought a rifle that turns out to be not what I expected. Seller has given me a 3 Day non-firing inspection and i'm thinking of returning it.
    Do I enter it in my BB as returned to seller or do I just return it without entering it at all?

    In short - I don't know - but to be safe. If it was me, I would enter all the relevant info, about purchasing it, date it, and then enter all the relevant info about returning it 3 or less days later as you mentioned you plan on doing.

    i.e. I'd rather show history that it was received, and then you decided to get rid of it, than have no records at all. That way in the event it's *ahem* lost in the UPS truck, or something... you have a paper trail. (I'd also keep the UPS receipt in your bound book or other permanent files with your bound book).

      Better to be safe than sorry. Leave as much of a paper trail as possible to cover yourself just in case.

        I would enter it in the BB. After all you did take possession of the firearm. Then just log it out when you return it. My .02 cents.

            What's the big deal. Log it in and log it out. Do you think the government is going to get on your case for too much paperwork.

              Just concerned that they would make a case for "being in the business". Plus I've never had to do something like this before, so I thought it would be best to ask about.

                  Good question and good replies. I'd log it too. I doubt anyone ever got in trouble for too much paperwork (especially when dealing with the govt). Here are a couple of things in the ATF FAQ that are sorta related and make the case for logging it IMO, especially if it spends the night in your safe.

                  (F15) Must a dealer record firearms received on consignment? [Back]

                  Yes. Firearms received for sale on consignment must be entered in the dealer's "bound book."

                  Sales of the firearms are handled in the same manner as other firearm sales. Return of the remaining firearms by the licensee to the consignor is entered in the dealer's disposition record. An ATF Form 4473 and a NICS check must be completed.

                  (I2) Does a gunsmith need to enter in a permanent "bound book" record every firearm received for adjustment or repair? [Back]

                  If a firearm is brought in for repairs and the owner waits while it is being repaired or if the gunsmith is able to return the firearm to the owner during the same business day, it is not necessary to list the firearm in the “bound book” as an "acquisition." If the gunsmith has possession of the firearm from one business day to another or longer, the firearm must be recorded as an “acquisition” and a “disposition” in the permanent "bound book" record.

                    Log it in, and Log it out. Don't worry about them thinking you're doing business. if you ever got an audit, they'll see it come to you and go back to the seller, they'll figure it out...

                      Unless you return the firearm on the same business day that you receive it, you must enter the acquisition in your bound book.
