Carbine question... and laws...

Hi All,

An M1 Carbine is technically an assault weapon by California law..

It is a semi auto centerfire that has the ability to accept a detachable mag and a bayonet lug... Is the ruifel legal because it is a curio and relic...

lets say you have an M1A1 paratrooper carbine... it has the above plus the pistol grip and folding stock... are these legal in CA .... are curios exempt from the assault wepaons laws???

First off, bayonets were banned under the 1991 Federal AWB, there is nothing in SB23 pertaining to them, and no, an AW is an AW regardless of age

Second, folding stock and pistol grip are banned features when used on a semi auto with detachable magazines. So basically, you're going to have to leave any M1 Carbine bone stock in California. Not that the should be changed at all anyway.

An M1 Carbine configured normally (even with a bayonet lug) is completely California legal.

A paratrooper M1 Carbine is not legal to own in California if it wasn't registered in a previous AW registration period. There is no C&R exemption to the AW ban.

Technically, you could possess a para M1 if for example, the magazine release catch was disabled, leaving you with a fixed magazine rifle (somehow, you would have to top load the magazine from an open bolt). The folding stock would also need to be altered so it can no longer be folded (therefore keeping a permanent overal rifle length of over 30").

By having a fixed 10rd magazine rifle, this would permit you to have a pistol grip on the rifle (considered an "evil" feature). An important point is - the M1 para would have to have the fixed mag and non-folding stock modifications done before it can be brought into CA.

well you could also do what i was planning to do with my universal and turn off the gas port and use it bolt action and keep the side folder working and not fixed.
