    Michel & Associates, PC Release Legal Memo re "Replicas" as "Antique Firearms"

    Just wanted to make people aware of this memo and thought this would be the best place to post it. It is a discussion about how the availability of rare ammo via the internet may have an impact on the status of some "replicas" currently being considered "antique firearms." You can find the article and a link to the memo here:

    Collectors of "replicas antique firearms" have been able to buy and sell these collectibles without going through the usual arduous federal and state law required process for acquiring modern firearms. This has generally been legal because a "replica" of an "antique firearm" is not considered a "firearm" under federal or (most) state laws, and so

          I'm sure this will be a dumb question, but does newly built replicas of classic WWII firearms, such as the TNW PPsH-41 (http://www.tnwfirearms.com/guns_ppsh-41.shtml) fall under the guise of a antique and something that I could purchase directly?

          I called TNW, and they said this rifle had to ship to an FFL 01 directly.

          Wait...nevermind...I actually read the brief and noticed the pre-1898 clause....case closed....

            Actually the complete quote is “uses rimfire or conventional centerfire fixed ammunition which is no longer manufactured in the United States and which is not readily available in the ordinary channels of commercial trade.”
            So if ammo is munufactured in the US, that fact alone can remove firearm from 18 USC 921(a)(16) subsection (B), because ordinary channels of commercial trade, can apply to ammo availabe from other countries, not the US.

              but i am confused... i thought there was 3 reasons a fire arm went C&R and one of them is the 50 year clause... so are we good to go solely on that fact?

                C&R ≠ Antique (or replicas thereof). Two different things.
