    C&R handguns

I know how to use the 'search' button but I am unable to find what I seek.

I have some older handguns (colt's, S&W triple locks etc..) that I am considering moving out to make way for new stuff.

Nearly all of it is over 50 years old. Is this considered C&R based on age or must it be on a specific list?

If a buyer has a valid C&R must the transfer go through a ffl? Or can I sell it directly to him while keeping a copy of his C&R?

    Thanks for the info...

I think with handguns in CA everything must go through a dealer if from out of state, C&R or not. I am guessing because I don't believe I can get a CZ-52 shipped straight to my door from online.

Yes, if they are over 50 years old then they are considered C&R based on age. The list of C&R firearms that ATF makes is for guns that aren't yet 50 years old but have collector value. There is older stuff on the list because they never remove stuff from the list.

If the buyer is in California then you will need to do the transfer through a Dealer FFL even if the buyer has a C&R FFL. If the buyer is in another State and has a C&R FFL then you can ship the C&R handguns directly to them. Well, for most States anyway. There are a couple of exceptions.

That is correct, unless both parties are located outside of the state at the time of purchase/ sale.

in which case its just cash and cary and the seller keeps a copy of the C&R licence of the purchaser.

IIRC you don't have to go through a dealer if you have a C & R and a COE. Someone correct me if I'm wrong.

whoah.... no Matt... you're exempt from the waiting period with the C&R and COE as well as the 1 gun per month thing.

however it still has to go through an 01FFL if you are physically in the state

to do otherwise is highly illigal (though if you did it prior to 1991 it was totally legal)

Okay, thanks for the info... they will just have to go through a ffl when offered up.
Whatever special stuff having a C&R gives you regarding waiting periods etc... will be between the buyer and the ffl (provided the buyer has a C&R).

                Thanks again...

Well, it's late enough for me to get my facts wrong. Sorry

That's correct all C&R handguns must be transfered through a FFL01 and has a 10 day wait (unless you have a C of E), but can someone clarify something for me....

1). A FFL03 (without CofE) still has the 10 day wait on a C&R handgun, but does the 30 days between handgun rules still apply to C&R handguns?

                    2) You are still required to have a HSC with a C&R handgun purchase?

Life can make you do many things, even kiss a man with a runny nose.

                      1) yes. You need both C&R + COE to exempt you from the 1-handgun-per-month rule, regardless of the firearm's C&R status.

                      2) now that's a really good question. IIRC, If you are taking possession of the handgun in the state of CA, then yes, you still need an HSC. However, it's a bit unclear if a HSC is required if you buy the handgun out of state (for example, if you road trip it to AZ).

My take on this is - if you have a FFL03 and buy a C&R handgun out of state and bring it back by road, you have to register the handgun with the CA DoJ within 5 days. Since the handgun is already in your possession and is not required to deal with a FFL01, there is nobody to take your HSC test and affidavit. So no, I think there is an exemption for the HSC there.

I'm just curious whether a HSC is still mandatory on a C&R handgun bought or transferred through a FFL01 in CA.

you're required to have an HSC when doing a family handgun transfer, so i'd think so...

You are exempt from the HSC requirements if you have a CCW!
