    Is sks C&R?

I have a early 50s russian SKS. Would this be considered C&R? Can it be sold with no FFL?

    Russian SKS's are indeed C&R.

But only face to face. Mail requires receiver to have a C&R or 01 FFL.

It should be clarified that one Californian can sell it to another Californian without going through an FFL. That's because it is a C&R long gun that is at least 50 years old, so it is exempt from California's Dealer transfer requirements.

If you want to sell it to somebody who is a resident of another state then an FFL needs to be involved. Either the buyer needs to have a C&R FFL or you can ship it to a Dealer FFL in the buyers state. This is a Federal requirement since the transaction is crossing State lines.

This is not true. An FFL is only required for this transaction with the Russian SKS if he is transfering it to an out of state resident, and then he would need an FFL involved no matter if he was shipping the rifle or selling it face to face.

If he is transfering the Russian SKS to another California resident then shipping it without going through an FFL is perfectly legal. It might not be the smartest thing to do, but it is legal.

So let me see if I understand this correctly, a non 03 FFL California resident can have a C&R longarm delivered directly to their home by another California resident. But, to purchase the same, from an out-of-state seller, one would have to be an 03 FFL holder, correct?

Both correct under federal and PRK law for long guns.
