    Quick question on selling C&R rifle; bear with me.

    How do I go about selling a C&R rifle that I bought off a normal gun store?

    Can I still sell it like I would any other C&R do I need to do anything special because a 4473 was filled out?

    C&R is C&R. Doesn't matter where you bought it. As long as it is a long gun and 50 years old it's good to go in a face to face transaction.

        The key is it has to be 50 years old or older to be sold in a PPT.Not all C&R rifles are 50 years old example the some Yugo SKS.

          Oh, it's fine.

          I actually posted the question in a theoretical POV.

          Let's just say that now that both parties know this perfectly legal, I got me a Mauser 98/48 that's beat to hell.

          It's missing more parts than a Russian capture as well, not to mention it got ruined cosmetically.

          It is mechanically sound, however...

          I'll have to make a new thread about it sometime.

              You're so close. You've almost got it. As Trickster and PezHead265 already mentioned above, the long gun must also be at least 50 years old.

                I thought CA law doesn't consider it c&r unless it is 50yrs old . . .

                  CA does not have its own C&R definition. It relies on the federal definition. CA just has an additional requirement for paperless long gun that they be C&R AND 50 years old. But the C&R defintion still appplies for firearms <50-years old. For instance, I could buy a C&R firearm gun that was less than 50-years old from an FFL and use my C&R+COE to exempt myself from the 10-day wait. That is because CA law says that if it is C&R, I am exempt. It doesn't have to be 50+ years old to fall under that exemption.

                    Is a CA ID or DL photo copy a necessity for the seller's bound book? Do I have to fill out and send in a "firearm no longer in my possesion" form?

                      since long guns are not normally registered "in your name", there usually is no need to send in an NLIP form when you sell one.

                      As for a copy of the ID/DL for your bound book,


                      (f) Firearms receipt and disposition by licensed collectors. Each licensed collector shall enter into a record each receipt and disposition of firearms curios or relics. The record required by this paragraph shall be maintained in bound form under the format prescribed below. The purchase or other acquisition of a curio or relic shall, except as provided in paragraph (g) of this section, be recorded not later than the close of the next business day following the date of such purchase or other acquisition. The record shall show the date of receipt, the name and address or the name and license number of the person from whom received, the name of the manufacturer and importer (if any), the model, serial number, type, and the caliber or gauge of the firearm curio or relic. The sale or other disposition of a curio or relic shall be recorded by the licensed collector not later than 7 days following the date of such transaction. When such disposition is made to a licensee, the commercial record of the transaction shall be retained, until the transaction is recorded, separate from other commercial documents maintained by the licensee, and be readily available for inspection. The record shall show the date of the sale or other disposition of each firearm curio or relic, the name and address of the person to whom the firearm curio or relic is transferred, or the name and license number of the person to whom transferred if such person is a licensee, and the date of birth of the transferee if other than a licensee. In addition, the licensee shall—

                      (1) Cause the transferee, if other than a licensee, to be identified in any manner customarily used in commercial transactions (e.g., a driver's license), and note on the record the method used
                      you must note the DL# or other identification in your bound book, but I see no requirement that you have a copy fo the DL.
