HELP - What does a FFL need to accept a out of state C&R?

    HELP - What does a FFL need to accept a out of state C&R?

    I am having no luck in receiving my a C&R rifle I purchased from an out of state seller. First, the FFL took days to fax his FFL over to the seller. After 3 days of waiting the seller contacted the FFL directly and was told 'unless the out of state seller has a letter or number from the state of CA' my FFL cannot accept the rifle. The seller is ready to cancel the entire deal. Can someone with C&R experience help me to understand what I need to do to receive my rifle?

    Is the seller an FFL or a private individual?

    If it's a private individual, nothing more is needed, find a different California FFL that understands the law.

    If the seller is an FFL, then he needs to have the California "CFLC"


    I don't believe there is any cost, and it's a very quick process. Any FFL that ships into California needs to have this.

      I am not sure if the seller has and FFL or not. However, why can't he just send it to my FFL as a private seller? I am really disappointed with my FFL as he did me sold the last time I used him and I have recommended him to several other Calgunners. I just don't want the seller to throw his arms up in disgust over the whole deal and cancel the transaction.

        Your FFL is probably talking about a Firearms Shipment Approval Letter .http://www.ag.ca.gov/firearms/cflcoverview.php

        C&R long guns are exempt from this requirement, as are firearms being shipped by C&R holders or private parties.

          Okay. I talked to my FFL and found out the seller has a C&R 03 FFL. According to my FFL the seller needs to be registered with the the state for the California Firearms Licensee check (CFLC) program. However when I read the the memo in the post listed above at http://ag.ca.gov/firearms/infobuls/2008-BOF-01.pdf
          The requirements for a CFLC are:

          "Beginning July 1, 2008, PC Section 12072(f)(l) prohibits all FFL holders (other than Type 03 or 06) from delivering, selling or transferring a firearm (excluding curio & relic long guns) to an FFL in California unless, prior to delivery, the person intending to deliver, sell, or transfer the firearms obtains a verification number from the DOG. THIS INCLUDES CALIFORNIA FIREARM DEALERS AND MANUFACTURERS WHO ARE ACTIVE ON THE DOJ CENTRALIZED LIST, WHO TRANSFER FIREARMS TO ANOTHER FFL WITHIN THE STATE."

          I interpret this to state that type 03 dealers are except and also that C&R long guns are exempt. Am I reading this wrong? The FFL did his own search and he was inconclusive on how to proceed and suggested I contact the DOJ tomorrow to get a decision.

          Am I off base here?

            You are right and your FFL doesn't know what he's doing. Take the advice posted above and find another dealer.

              No you're not off base. The text you quoted from CalDOJ specifically says that Type 03 FFL's are exempted from having to get a verification number and that C&R long guns are exempt as well.

                Yup your FFL is confused. Nothing newfangled is required to receive a gun from an 03 FFL.

                  Your FFL is suggesting that you contact DOJ? You are paying him for the transfer, right? It's not your fault that he can't understand English. Tell him to call DOJ and get his act together. If he is not willing to, find another FFL and let us know who he is so we can all avoid him. May I also suggest that you get your 03 FFL so that C&R rifles can be shipped directly to you in the future.

                      I decided to go with another FFL for my transfer. I am disappointed that the FFL would not do the leg work for my business. So I am walking away and don't intend to go back.

                      Anyways, Riflegear stepped forward to help me out with my transfer and now my rifle is on it's way! Riflegear to the Rescue!
