C&R license question

I do not have my C&R license, can I sell a C&R eligible rifle to a person holding a valid C&R license without going through a PPT? I'm assuming I need to get a copy of the person's info for my "records". I thought I read somewhere that no matter what, in the state of Kalifornia the 10 day wait still applys, but what about out of state. Can I ship a rifle to someone directly if they possess a valid C&R license?

You can sell to a C&R holder, either in or out of California, without the 10 day wait. Get a signed copy of their 03 license
for your records. This is for long guns only. Handguns need a dros and ppt. Yes you can ship; again, get a copy of their license and present at UPS, USPS or FEDEXs or wherever to show you are shipping to a licensed person.

He doesn't have a C&R. He's not subject to ATF/DOJ audits.
All he needs to do is ship the thing and provide HIS information to the C&R holder for his bound book.

If he feels better about having evidence that the C&R holder is not a prohibited person, he can request a copy of the C&R, but there is no legal requirement for a non-C&R holder to do anything other than "be persuaded" that the receiver is not a prohibited person.

I have had to prove to the shipping company (UPS specifically) who I was shipping to. If he doesn't want one, i suppose your are correct but i have always leaned on the side on caution.

If he's shipping out of state, ya... he might need one for the shipping company.
Shipping within CA, neither needs to be an 03.... but either way, once it's shipped, he can line the catbox with it.

I was just taking issue with the "for your records" note, not saying that it's a bad idea to get a copy of the 03.

No problem, I have always tried to get any info in case someone (official) knocks on my door and asks about one I sold 10 years ago. I try and keep a trail just for me (my personal records) even before I got my 03.

Just being overly cautious especially for the state we all live in.

Certainly understand that.

OTOH, since C&R are cash and carry, and long guns aren't registered anyways, there's nothing that ties that weapon to you prior to your sale unless you bought it from a dealer or an 03....

If someone knocks on my door about a gun I allegedly sold 10 years ago, I would prefer to have nothing in my possession tying me to it

If the buyer is in California then you can only transfer a 50+ year old C&R long gun to them without going through a PPT.

Nope. The 10 day wait only applies to most transfers done through a California licensed dealer. Transfers that are exempt from the California licensed dealer requirement are automatically exempt from the 10 day waiting period.

If the buyer is a C&R FFL from out of state, you can directly ship them a C&R rifle of any age or a C&R handgun of any age. If you go outside of California to meet with the C&R FFL then you can even transfer C&R handguns and C&R long guns of any age to a California C&R FFL. For instance, if you drove to Nevada to meet a California C&R FFL who was also visiting Nevada you could transfer a C&R handgun to him directly.

As already mentioned above, there is no legal requirement for you to get a copy of the C&R FFL's license, but it can't hurt to get a copy. You should verify that a C&R FFL is valid by calling the BATFE EZ-Check phone number...1-877-560-2435...and asking. C&R FFL's can only be validated by phone. The online FFL EZ-Check system doesn't contain C&R FFL information because of privacy concerns.
