    Online Purchase Restrictions?

    Hey Guys

I want to buy a Winchester 1890 pump action, .22 short gallery rifle from an out of state private party...he says that he must ship to an ffl here in Ca which is fine. The rifle was manufactured in 1912 and holds 15 rounds.

Are there any CA. restrictions I need to be aware of?

Do I have to wait 10 days?

    Thanks

Do you have a C&R license? If you do it can be sent right to your front door. If you don't, yes it must go through an FFL01 and all other California rules apply. 15 round tube magazine in that .22 is just fine.

    Food for thought,
A C&R is $30 for three years and you can buy all the 50+ year old long arms you can afford. How much is that FFL transfer going to cost you?

you just have to determine if your local FFL is willing to accept a shipment from a non-licensee (private party). If so, then the seller ships it to the FFL and you do the paperwork (DROS) and wait the 10-days. The FFL can charge any fee he wishes to do the transfer, expect to pay $25 DROS + $50-150 in dealer fees, depending on where you go.

If your FFL won't accept shipments from non-licensees, then the seller will need to use an FFL to ship it, and that FFL will need to deal with some CA-requred CFLC paperwork before sending it to your FFL. That'll probably cost you another $25-50.

Since it is a .22lr tubular fed rifle, the fact that it holds 15-rounds is ok and not a violation of the large-capacity magazine restrictions.

Do you want an AOW or C&R SBS/SBR in CA?

Here is my condensed guide on how to get a C&R FFL

Go to http://www.atf.gov/forms/dcof/ and request F 7CR (5310.16) - Application for License (Collector of Curios and Relics) Under 18 U.S.C. Chapter 44, Firearms..

On-line copies of the application you may find are out-of-date, obsolete, and not acceptable by BATF.
You MUST use the application that ATF sends you. You cant even use a photocopy of the form.

They will mail it to you, fill it out per the instructions, send one part back to BATF +$30, send second part to the CLEO that you refered to on the form, wait ~2 months, receive approved C&R FFL in mail.

YOu can purchase C&R firearms (of any age) (no AW's or NFA stuff) while out of state, cash-and-carry, and bring back with you with no in-state dealer needed. C&R handguns that are brought in require you to submit a C&R handgun report within five days. http://ag.ca.gov/firearms/forms/pdf/curioapp.pdf

C&R long guns over 50 years old can be purchased in-state from any non-dealer or can be shipped into the state via a mail/phone/web order.
C&R long guns under 50 years old must be transfered through a CA dealer if you are physically in CA when you take possession.
Any C&R handguns purchased in-state or on-line must go through a CA FFL.

If you get the COE in addition to your C&R FFL, then you can DROS C&R firearms and take them home immediately, no 10-day wait.

To get the COE, Certificate of Eligibility, download the app at http://ag.ca.gov/firearms/forms/pdf/coeapp.pdf. Just follow the directions on how to fill it out. Included in the directions is a URL to a list of Live Scan locations where you'll have your fingerprints electronically scanned and sent to CADOJ and the FBI.

The COE is more expensive, around $100 in fees for the first year, but the renewal is something like $20 bucks per year. It has a very limited use in CA, but when used in conjuction with the C&R FFL, exempts you from the 10-day wait on C&R purchases (handguns and long guns) from a dealer (still must DROS it), and exempts you from the 1-in-30 handgun regulations for ALL handguns, modern and C&R.

When/If the mail-order ban portion of AB962 goes into effect, the C&R+COE combo will also allow you to do mail-order handgun ammo, provided the seller understands the exemtpion.

If you get your C&R FFL, you are not required to get a COE if you don't want one. You just don't gain the privledges that the 03+COE combo extends.

Your CLEO is your local police chief and/or county Sheriff.

You can also check out http://www.surplusrifle.com/shooting...fl03/index.asp for more info.

Excellent information but your ATF link seems to have changed.
Follow this link and navigate to the order page. You don't send any money until you actually send the forms back.

Don't let ATF legalese intimidate you either. Getting the license is actually fairly painless. Just be prepared to wait a few weeks to a month or more for them to send it back to you and you'll be your own FFL! I don't have a COE myself and it isn't required if you do most of your buying out of state, like I do.
