CLEO sent C&R from back

    CLEO sent C&R from back

    Sheriff's office called me today and no amount of convincing or BATF referances would make them believe that I needed to send them a copy of my C&R application. They are sending it back to me with a memo (so at least I can officially say they got it) that says I need to send both copies to the BATF with a $30 fee and they have nothing to do with it. Am I safe here or do I need to actually go in with some BATF publications?

    Mine was thrown away by the desk cop at San Jose PD headquarters, in front of me. He told me I didn't know what I was talking about and if I didn't leave I would be arrested.
    That was with a letter from the SO explaining the residency law.

      hmm. weird. i would send only the one copy in to batfe anyways, since the leo doesnt really have a say as to whether or not you can have a c&r. i dont think the batfe even calls the cleo, cleo only gets a copy in case you are somehow a felon, yet not on the federal background check or something... double checking each other maybe... send it in! you did your part lawfully.

        ATF's only requirement for you is that you send the CLEO a copy. What they do with the copy once they receive it is entirely up to them.

                You're safe, you did your duty and sent it to the CLEO. That they don't know what to do with it isn't your problem. I'd suggest keeping the returned copy, with the envelope and the memo for your records. With that, you actually have more proof of having sent it to the CLEO than those of us who had no issues with the CLEO copy.

                  Thanks for the info yall. I was pretty sure I was safe just wanted some sea lawyers reassurances. I am just glad that they are sending me a memo too for further proof.

                    BATFE requires that you notify the CLEO. The Local CLEO doesn't need to do anything - no filing, no record keeping, nothing; they just need to know you're collecting C&Rs.

                    My Local CLEO sent it back to me saying he doesn't need it - he knows me anyway, so he REALLY doesn't care. You've completed your requirement, time to wait for your C&R, COE, and start making a list of all the vendors you want to buy from.

                    If you want to keep the memo, that's fine, it doesn't hurt to keep all your paperwork.

                      my local PD called me up. they asked what the license was for and if i would be selling firearms out of my house. i said no, its for collecting classic weapons. he said ok, have a nice day.

                        Yea I'm sure mine got sh*t canned too when I sent it to SFPD.

                        Iffy, that's what happened to a friend of mine who lives in Millbrae, they called him up and asked the same thing, they had no issues.

                          I've been contemplating getting one for my place in NYC....

                          not going to have any firearms in the appartment, but it would be nice to be able to go buy something and keep it in PA to go hunting with (and it would get me around the residency issues involved with that)

                          I don't think the misses would be ok with it however.... tactical squads kicking in the door would be not cool....
