C&R question

I have searched for the answer in the thread but can't find anything and could use some help.

I have 2 C&R 8mm mausers that I am going to sell. The both are not original military setup. One has the original lower stock buy no top stock and the other has a new stock and the bolt handle cut and welded to allow a scope to be mounted.

Can these still be sold C&R?

AFAIK...

As long as the reciever/frame is 50 or more years old, it is considered a C&R firearm.

I thought it had to be in it's original military setup to be c&r. The missing part of the stock is ok since all it would have to do is be replaced. The other one should be ok as long as the new stock is the same as the original.

From the FAQ at the end of the C&R list:

Frankly, this makes no sense to me, unless you are talking about a firearm on the C&R list that is under 50 years old. The way I read it, Item 1 of the definition is pretty clear, and replacing the stock won't magically make it less that 50 years old. I can see if you were hacking up a Ishapore Enfield built in the 1970s it would lose its C&R Status, but on a Mauser made in the 30s or 40s it doesn't make sense.
