      you don't need the 5330.20 anymore. It is built into the C&R app.


      YOu can purchase C&R firearms (no AW's or NFA stuff) while out of state, cash-and-carry, and bring back with you with no in-state dealer needed. C&R handguns that are brought in require you to submit a C&R handgun report within five days. http://ag.ca.gov/firearms/forms/pdf/curioapp.pdf

      C&R long guns over 50 years old can be purchased in-state from any non-dealer or can be shipped into the state via a mail/phone/web order. Any C&R handguns purchased in-state must go through a CA FFL. If you also get the COE, then you can DROS C&R firearms and take them home immediately, no 10-day wait.





      To get the COE, Certificate of Eligibility, download the app at http://ag.ca.gov/firearms/forms/pdf/coeapp.pdf. Just follow the directions on how to fill it out. Included in the directions is a URL to a list of Live Scan locations where you'll have your fingerprints electronically scanned and sent to CADOJ and the FBI.

      The COE is more expensive, around $100 in fees for the first year, but the renewal is something like $20 bucks per year. It has a very limited use in CA, but when used in conjuction with the C&R exempts you from the 10-day wait on C&R purchases from a dealer (still must DROS it), and exempts you from the 1-in-30 handgun regulations for ALL handguns, modern and C&R.


      Your CLEO is your local police chief and/or county Sheriff.

        Its there as question #10, "nonimmigrant Alien Certification of Compliance with 18 USC 922(g)(5)(B)".

        AFAIK, everybody lately has been able to just send in the green form by itself and get an approved C&R FFL with it. Did BATF contact you and require you to submit a separate 5330.20?

          As for the COE not being "worth it?", it depends. Do you find yourself delaying handgun purchases due to the 1-in-30-day limit? If so, then the C&R+COE is worth it to exempt yourself from the 1-in-30 rule.

          Or, if you want to cash-and-carry C&R firearms of any age from a dealer, then the C&R+COE is worth it.

          And yes, it appears that the C&R+COE may be of benefit if the handgun ammo restrictions go into effect.

            that makes it worth it, lol I have been reading your conversation as I just applied for my C&R like three hours ago! So adding the COE would exempt me from the online ammo ban? Or just the fingerprinting in store?

              we're not entirely sure how its gonna work out. CADOJ may have to write some supporting regulations to clarify how this will all work.

              Realize that the effective date of the ban is still 15 months away and it was only signed this month.

                  I ordered my forms on 10/14; received in mail on 10/19; completed forms mailed out on 10/20.

                  The only use I would have for COE is if the ammo regulations go into effect, so I can wait a few months and save some cash.

                    I get the 1-in-30 rule, but if I have a C&R and a COE am I also exempt from the 10 day wait on modern handguns when purchasing from a dealer in state? What about on modern long guns?

                    If so, its worth getting. I don't have much interest in C&R but having no wait and no 1-in-30 restriction would be a nice-to-have.

                      1-in-30 exempt for C&R and modern handguns. 10-days wait still applies on all modern firearms. 10-day exempt on all C&R firearms, either by age or by specific listing in the book.

                              03FFL+COE holders appear to be exempt and will be able to mail-order ammo. We'll see how many out-of-state vendors can be made aware of that clause and be convinced to honor it, however. We all know the way many of them already feel about doing business with Californians...

                              Not that it's terribly hard to find, but if you search for AB962 the older versions will often pop up. Here is the final bill as signed by the Guvenator:



                              12318. (a) Commencing February 1, 2011, the delivery or transfer
                              of ownership of handgun ammunition may only occur in a face-to-face
                              transaction with the deliverer or transferor being provided bona fide
                              evidence of identity from the purchaser or other transferee. A
                              violation of this section is a misdemeanor.

                              (c) Subdivision (a) shall not apply to or affect the deliveries,
                              transfers, or sales of, handgun ammunition to any of the following:

                              ...(6) Persons licensed as collectors of firearms pursuant to Chapter
                              44 (commencing with Section 921) of Title 18 of the United States
                              Code and the regulations issued pursuant thereto whose licensed
                              premises are within this state who has a current certificate of
                              eligibility issued to him or her by the Department of Justice
                              pursuant to Section 12071.
