Having recently obtained a Type 03 FFL, and having reviewed a number of threads in this Forum as well as information on other sites such as Calgunlaws, I'd like to ask a question to ensure that I have the correct view of the allowances and requirements under this license. As I understand it, I'm not required log into my acquisition and disposition book any C&R firearm that was legally obtained without use of my C&R FFL (such as, say, through a Type 01 FFL dealer, or by a legitimate in-state C&R long gun cash and carry purchase). It seems some people log these purchases anyway, just to be safe, but it isn't a requirement. However, if not logged in, then that firearm cannot be disposed of using one's C&R FFL, but must instead be legally transferred via other means, such as through a Type 01 FFL or a legitimate cash and carry transaction. Do I have a correct understanding of this? Do experienced C&R FFLers recommend logging in all C&R acquisitions even if obtained without the C&R FFL use (so as to allow disposition via the C&R FFL if need be)? TIA for all informed opinions!

BATFE has issued conflicting opinions on whether you need to log purchases that you didn't "use" your C&R for. The most restrictive opinion, and the one that makes the most sense, is that you ARE licensed, you don't USE your license, and that you log all activity that occurs while licensed.
So, log in that C&R firearm that you bought from a CA 01 FFL or from a CA cash-and-carry transaction to be on the safe side. You don't want to end up getting audited and have the examiner nail you on unlogged firearms. Better to have too much info in your bound book, than not enough.Jack

yes, you should log ALL activity that occurs WHILE you are licensed. So, if you had a C&R firearm that you acquired pre-license, and were going to dispose of it while licensed, you would log it into your bound book, noting that it was a pre-license acquistion, or words to that effect, and then log it out to the buyer. That does not mean that you have to log all your pre-licensed acquisitions, only those that you dispose of while licensed.Jack

Here is what the law says about it...
Using the above bolded section of the law I have come up with an easy to use three step process for knowing when to log something into your bound book. You can use this three step process for anything you acquire or dispose of, be it a new car, a bag of trash, or a C&R firearm...Each licensed collector shall enter into a record each receipt and disposition of firearms curios or relics. The record required by this paragraph shall be maintained in bound form under the format prescribed below. The purchase or other acquisition of a curio or relic shall, except as provided in paragraph (g) of this section, be recorded not later than the close of the next business day following the date of such purchase or other acquisition...
Step #1 Am I a Licensed Collector? If yes, go to step #2. If no, stop here.
Step #2 Did I just acquire or dispose of something? If yes, go to step #3. If no, stop here.
Step #3 Is that something a C&R firearm? If yes, log the transaction into your bound book. If no, stop here.__________________

Okay, glad I asked, so as a C&R FFLicensee, I need to log all C&R acquisitions and disposals, whether or not I actually used my 03 FFL to transfer the firearms. Just received my C&R (woohooo!). The license came in an envelope, but no package containing the 'starter kit'. Do I need to ask for that separately, or is it coming later?Last edited by olhunter; 07-26-2009, 4:45 PM.It cannot be inherited, nor can it ever be purchased.

you will get a second package containing some paperwork and a couple books on state and federal laws (may have been replaced with a CD lately). You will not get a bound book. You need to supply your own by either buying one or DL'ing one online.Jack

Cool...2 weeks seems to be about average, which is pretty reasonable by government standards
I wonder why it takes them so long to get the application mailed out.
