    C&r + C.o.e.?

    At an auction last week I came prepared to bid on, win (optimist) and take home a mil-surp rifle (C&R listed). Auctioneer/owner flatly stated that ANY person receiving any C&R firearm without having a California COE is committing a felony...therefore refused to release the firearm and stated that not only do I have to come back to DROS it, I have to wait 10 days.

    It was NOT sold as "from a dealer" by the way...but my guess is that since they collect sales tax it's somehow re-classified.

    Remember, hell is defined as a place without reason.

    Many years C&R experience...never once heard this before.

    I've got a call in to Sacramento...as if that will clear anything up.

    Any other members come across this?

    it happens. then again, we've all heard the stories about people at the gun show saying we're all fellons if we don't buy THEIR OLL...

    you can try printing out the relevant sections of law and showing him, but usually they don't care.

    and just because it gets asked enough, here's the deal:

    *RIFLES, SHOTGUNS, AND FIREARMS NOT EASILY CONCEALABLE ON THE PERSON*
    Any rifle over 50 years old may be transfered between two residents of California without going through a 01 FFL (no DROS, no waiting period, it's just like buying a pack of gum). You don't even need a C&R licence for this to apply.

    Any rifle over 50 years old may be shipped straight to your door if you have a C&R licence. No DROS, No waiting period, just like ordering a pack of gum off the internet.

    Any rifle in the inventory of a 01 FFL goes through a DROS, regardless of how old. This means if you go to Big 5 to get some old yugo mauser, it still gets DROSed regardless if you have a C&R license or not (this does not apply to a 01 FFL's personal guns, just his store inventory i believe)

    If you have a C&R license and a COE, you may skip the 10 day wait on C&R guns ONLY

    *HANDGUNS*
    If the gun is already in the state of California, it must go through a 01 FFL and get DROSed, regardless of your C&R license

    If you buy a C&R handgun off the internet, it still has to go through a 01 FFL and get DROSed.

    If you are physically outside of california: you can purchase C&R handgun outside the state. Usually cash&carry, but depends on the state law of where you're at. When you return to Cali, you must send a form and $19 to the DOJ (example: you can drive to arizona, buy a CZ-52, and bring it back as long as you send off the form and fee)

    If you have a C&R licence and a COE, you can skip the 10 day wait on C&R GUNS ONLY.

    if you have a C&R licence and a COE, you can skip the 1 handgun a month rule (not just c&r guns)
