    1 in 30 question

    So I just bought a new handgun yesterday new little s&w shield but just saw sportsman has some sks rifles in stock and on sale can I go pick one up under my c&r license or do I have to wait ? Still learning about how to use it would be my first c&r purchase

    Sure if Sportsman understand how to process or its internal policy allow to process 03/coe exemptions. Also doesn't looks like Sportsman's policy would let 03/coe release on same day.

      Yes because it is a Semi Rifle, but that does not prevent you from putting money
      down and deferring the sale for 30 days from your last DROS date. I seen them
      honor a deposit for 30 days. Fact is very common during COVID gun run, people
      were paying money upfront for guns that were on order. So go ahead and get that
      SKS, you wont regret it, they are great rifles to have.

        Yea just hearing about this spoke with the guy from the counter said no problem with the 1 in 30 but won't do cash and carry at least at his store they won't

          Valid C&R 03-FFL by itself = no exemptions to any CA waiting periods.

          Valid C&R 03-FFL + valid COE = exempt from 10 day waiting period for C&R firearms [PC 26970] and exempt from 1 in 30 day wait for handguns & semi-auto centerfire rifles [PC 27535(b)(9)].



          Penal Code 26970
          (a) The waiting period described in Section 26815 does not apply to the sale, delivery, loan, or transfer of a firearm if all of the following conditions are satisfied:
          (1) The firearm is a curio or relic, as defined in Section 478.11 of Title 27 of the Code of Federal Regulations, or its successor.
          (2) The sale, delivery, loan, or transfer is made by a dealer.
          (3) The sale, delivery, loan, or transfer is made to a person who is licensed as a collector pursuant to Chapter 44 (commencing with Section 921) of Title 18 of the United States Code and the regulations issued pursuant thereto.
          (4) The licensed collector has a current certificate of eligibility issued by the Department of Justice pursuant to Section 26710.
          (b) On the date that the sale, delivery, or transfer is made, the dealer delivering the firearm shall transmit to the Department of Justice an electronic or telephonic report of the transaction as is indicated in Section 28160 or 28165.

          Penal Code 27535
          (a) A person shall not make an application to purchase more than one handgun or semiautomatic centerfire rifle within any 30-day period. This subdivision does not authorize a person to make an application to purchase both a handgun and semiautomatic centerfire rifle within the same 30-day period.
          (b) Subdivision (a) does not apply to any of the following:
          (9) Any person who is licensed as a collector pursuant to Chapter 44 (commencing with Section 921) of Title 18 of the United States Code and the regulations issued pursuant thereto, and has a current certificate of eligibility issued by the Department of Justice pursuant to Article 1 (commencing with Section 26700) of Chapter 2.

            Have them contact corporate compliance. The Sportsman's I use will release C&R guns same day to 03/COE

                Do you have the COE as well? If so, you are exempt of the waiting periods, cash and carry are good to go.

                      I think the problem (mentioned in another thread) with the SKS at Sportsmans is they don't feel like they have any good way to date these SKS, so they are defaulting to 'not C&R' even though it is likely that a majority of the ones they are selling are C&R.

                      That is a decision we just have to respect IMO. China isn't giving up any official manufacture data on these, so the best we have to go on is info (some anecdotal) collected by hobbiests and catalogued on gun forums. Sportsman's doesn't want to risk their FFL on that info being good enough.

                      This is a problem with many C&R guns, and some FFLs just are not comfortable treating certain gun models as C&R without solid manufacturer provided data, or the gun being old enough that it just could not be any less than 50 yrs old. There are some guns out there who had a very long manufacture window that puts some in the C&R category and some not, but the records have been lost or destroyed or just never released to the public.
