C&R purchase in another state?

    C&R purchase in another state?

    Does anyone know if a Ca resident with a valid C&R and COE can purchase a gun in Oregon, walk out with the gun and bring back to Ca?

    Or...do a private party transfer in Oregon, walk with the gun and bring back to CA?

    Penal Code section 27565:


    (a) This section applies in the following circumstances:
    (1) A person is licensed as a collector pursuant to Chapter 44 (commencing with Section 921) of Title 18 of the United States Code and the regulations issued pursuant thereto.
    (2) The licensed premises of that person are within this state.
    (3) The licensed collector acquires, outside of this state, a handgun, and commencing January 1, 2014, any firearm.
    (4) The licensed collector takes actual possession of that firearm outside of this state pursuant to the provisions of subsection (j) of Section 923 of Title 18 of the United States Code, as amended by Public Law 104-208, and transports the firearm into this state.
    (5) The firearm is a curio or relic, as defined in Section 478.11 of Title 27 of the Code of Federal Regulations.
    (b) Within five days of transporting a firearm into this state under the circumstances described in subdivision (a), the licensed collector shall report the acquisition of that firearm to the department in a format prescribed by the department.

      The gun has to be C&R, and you don't even need a COE just a C&R. And no need to use a FFL you can acquire it directly from a private party in a parking lot if that state's laws allow it (most do). But you can also acquire a C&R gun from a out of state FFL while you are out of state, if they are game.

      You have to file a form within 5 days of bringing the gun back to CA.

        Under OR laws...

        All firearm transfers must be done through an OR FFL dealer. [ORS 166.435]

        There is no exemption for C&R firearms and for persons with a valid C&R 03-FFL.
        There is an exemption for antique firearms. [ORS 166.460]

        Therefore...

        Any transfer of a C&R firearm to a CA resident with a valid C&R 03-FFL must be done through an OR FFL dealer or through a CA FFL dealer.

        If the C&R firearm is acquired from/through an OR FFL dealer, then the CA resident with a valid C&R 03-FFL can legally bring the C&R firearm to CA and within 5 days of returning to CA with the C&R firearm, they must report it to CA DOJ. [PC 27585(b)(1) and 27565]
