Can you Ship C&R guns to an individual?

    Can you Ship C&R guns to an individual?

    Hey Guys,

    I was not able to find the answer when I searched for it. I am sure it is out there somewhere. Can someone respond with advise on shipping a C&R rifle? Perhaps paste the link to the discussion, assuming it already has been asked?

    Is the rifle over 50 years old, or is it a listed C&R <50 years old? If over 50-years old, CA law allows for you to ship it to another individual, no C&R FFL required. If less than 50-years old, must ship to a CA dealer.

    If shipping out of state, if it is a C&R firearm of any age, you can ship it directly to a C&R FFL, or a dealer, not to an unlicensed individual.

          Can we sticky this? Since I know sellers, buyers, and members have this question a lot. Also can someone quote the penal code that says this?

            But a lot of private sellers still refuse to ship.

            CA law requires that firearms be sold only to those eligible to receive.

            It does not have enforcement penalties specifically mentioned to "PRIVATELY OWNED" firearms sold to those not elgible.

            None the less since it does not specifically state that private individuals are not subject to such enforcement many folks error on the conservative side and feel they must comply with the eligibilitly requirements.

            So is the glass half full or half empty.

            Probably for civil complaint you could be held liable to the requirements of selling to those eligible.

            Problem is that private individuals do not have the instant background check available to them so many do things like copying the drivers license and such.

            I personally feel if you sell to a Calgunner that has some positive feedback for sales for firearms that went through an FFL that you have met the requirement if such a requirement actually exists.

            Every gun owners second worst fear is that they sold a firearm to a 13 year old that brought the gun to schoold and shot up his class. Our worse fear is that our own 13 year old broke into our gun safe and brought our guns to his school and shot it up.

            So because of the very very very very slight chance of selling to someone not eligible or because of confusion of the law you will find that 80% of those selling C&R over 50 years old on this forum will not ship though by those most informed on the laws say it is perfectly legal.

            So are you a buyer or a seller. None the less what is it that is for sale and if it is a good deal please pass it on if you pass on it.

                yup, if its a long gun over 50 years old you can ship direct to an individuals house, no 03 or 01 FFL required, must be WITH IN ca
