    C&R Question

So just trying to understand. As a CA resident, can I buy a gun on GunBroker or anywhere out of state California that's over 50 years old because it's considered a C&R gun? Can I (CA resident) travel to Arizona and buy a used gun from 1960's (because it's over 50 years old) and bring it back to CA?

    Any clarification is appreciated.

Yes, No. you can buy any gun over 50yrs old but it needs to go through a FFL. You can not buy C&R guns in another state without a FFL03 or better.

Thank you...So I can go on Gun Broker and buy any 50 year old gun on-line (that's being sold in CA or from another state) and have it shipped to my FFL?

If so, Why can't I shop in another state, pay for it over the counter, and have it shipped to my FFL in CA to do the paperwork?

That confused me. You need to hire an FFL/intermediary to shop for guns on your behalf in order to bring C&R guns to CA?

            1. Yes. GunBroker Seller will need to ship to your CA FFL to complete the C&R Dros. Many CA FFL only accept shipping from FFL to FFL not private party to FFL therefore some GunBroker sellers will not ship to CA.

            2. Yes. You can physically travel to AZ and purchase a C&R gun, upon coming back to CA you have 5 days to register via CFARS.

            3. Yes. If any gun store outside of CA has a C&R gun, that gun store can ship to your CA FFL for Dros.

Number 2is not correct. Only Federally licensed collectors can purchase C&R firearms out of state.

If you don't have a C&R license you can't purchase any type of firearm in another state and bring it back to your state of residence.

You could pay for it out of state and have it shopped to a FFL in your state and do the transfer.

Do you have a Curio and Relics license from the federal government...it's also called a C&R license or -03 license.

If yes, you can shop for it out of California, take possession, and fly or drive it back to CA. You need to report the purchase to California.

If not, easiest is to go to Gun Broker or similar, pay for it online, and tell the seller your regular dealer's address for shipping. Shipper will want info on your dealer's federal firearms license number, and a readable copy of your California ID or drivers license.

The reason for that is federal law.

Thank all of you for helping me understand.

So let's say I'm at a gun store in TN and I come across a vintage hand gun from the 1960's (example: Colt 1911 made in 1968) and I want to buy it. Can I buy it at that store? Do I tell the gunshop owner he can sell it to me but has to then ship it to my FFL in CA because I'm a CA resident?

No. I do NOT have a C&R license or -03 license but many of the guns I enjoy buying and collecting are vintage guns from the 1960's and earlier. How difficult/easy is it for me to get a C&R license? It sounds like it would make sense for me to look into getting a C&R license for my own personal use.....

If a gun is shipped to a CA FFL you don't need anything special, and it doesn't matter where you "buy" it. Paying a store in TN while you are there is no different than paying online with a credit card so it is perfectly legal. The "transfer" is what matters, and that means shipping.
To enjoy the benefits of the 03FFL (buying out of state) you will also need a CA COE (Certificate of Eligibility). That is "shall issue" but requires a fingerprint Livescan, and you have to renew annually. The total costs will be over $100. Renewal is cheap ($19? I forget I'm an August renew so it's been a while).

Since we find that you do not have a C&R license, the gunshop owner out of state ships it your licensee in CA. He will have to register himself and his store with the state of California prior to shipping the weapon to your FFL.

More than a few out of state licensees prefer NOT to register their shop with CA...just more paperwork and waiting time.

Get a C&R collector license. Since you are in CA also get a CA Certificate Of Eligibility (COE) that will allow you to acquire C&R long guns in the state of CA wirhout going through a FFL.

Plus a few other privileges, such as being able to mail order ammunition from out of state. Plus no 10 day wait for C&R purchases.

There are many threads here on how to apply for both licenses.

The out of state FFL just runs the receiving CA FFL's info through the CFLC (California Firearm Licensee Check) program. Takes about 5 minutes and it generates an approval that can be printed.

Out of state FFL doesn't need to register their business with CA, but rather use CFLC to ensure they're shipping to a legit CA firearms dealer.

Edit: out of state FFL does have to create an account on the CFLC program that includes FFL number, business name, etc. I can see why they wouldn't want to go through the hassle.
