    handgun question

    Probably in the wrong section, but this is the only forum I haunt so I thought to start here.

    I think that high cap magazines can only be used with the original handgun they were sold with, correct?

    A handgun from an out of state relative's estate, can it be brought into California? Can it be brought in with high cap mags?

    No...

    You cannot buy the high cap mags...

    However, you can buy as many parts for high cap mags as you want.

      You can use your legal high cap mags with any firearm in which they'll work.

      You can no longer import high cap mags into California.

        OK, so the mags are out, what do I have to do in order to bring the handgun into CA?

          You just need a ten round mag. The hi-cap mag has to be in pieces if you bring it into CA, and NEVER ASSEMBLED until you leave CA.

            You just need to file the right paperwork with the DoJ.
            If it's an inheritance or family gift it's OPLAW (Operation of Law): oplaw.pdf

            If it's a C&R gun and you have the 03 FFL it's the C&R Handgun report form: curioapp.pdf

            Also, it's not too hard to neuter a "high-cap" magazine before bringing it home. Just "permanently" attach a block or post to the floor-plate to restrict the number of rounds it will accept.

              Thanks for clarifying. It is not an inheritance, it would be a purchase from my cousin. It has two high cap mags, built ~98?

                Just have him take the mags apart and ship them to you, the handgun will need to go through an FFL.

                  Now if you bought a bunch of Mags before the ban on the mags took place. you can still use them. A bunch of guys and myself bought a bunch of mags for guns we never even owned yet before the ban just to have them in case.


                  even sold a few of them before the ban. when prices went way high..

                    Since it is not an inheritance, the handgun will either have to be on the California Roster of approved handguns or exempt from the Roster. Since you say it has magazines we can scratch off the "certain single action revolvers" exemption. And since you say it was manufactured in 1998 we can most likely scratch off the C&R handgun exemption. So if that handgun isn't listed on the Roster you might not be able to buy it from your cousin.

                      OK, just found the link of "safe" guns for CA, the gun is on it. So I would have to pick it up and register it? Or would I have to have it DROS?

                          OK, if the handgun is on the Roster, then your cousin can either ship it to your local FFL (if the FFL will accept shipments from non-FFLs, not all do. If so, then your cousin would need to have an FFL ship it, or you would need to find a better FFL), or deliver it to the FFL in person.

                          YOu would then go to the dealer and have it DROSed to you. You would need to show proof of residency and have a handgun safety certificate. YOu would then pay the FFL whatever fee he wanted to do the transfer, wait the 10-day waiting periond, and then pick it up. You will also need to comply with the safety lock regulations, so plan on buying a handgun lock from the FFL as well.

                          edit: you need to confirm that the specific brand/model is listed. A handgun that is hte same as a listed model, except for color may not be rostered, so double-check.

                            Your cousin will have to either ship the handgun to your local Dealer or take it there in person. If he's going to ship it, then you need to check with your local Dealer to see if he will accept shipments from non-FFL's. Some Dealers will only accept shipments from other FFL's.

                            If your local Dealer will accept the shipment directly from your cousin, then your cousin will have to ship it via UPS or FedEx overnight service. This will cost around $65 or so. Your cousin should include a copy of his State ID or Driver's License because your Dealer will want that information for his records.

                            Once the handgun arrives at your local Dealer, you can go in and start the DROS process. Your Dealer can charge you whatever he wants to for this kind of transfer, but most charge in the range of $65 to $100. You will also need to take the Handgun Safety Certificate test and pay $25 for the HSC card. Ten days later you can go back and pick up your new handgun. If your cousin didn't include a California approve gun lock with the handgun then you will need to buy an approved gun lock or sign the affidavit saying that you have an approved gun safe or cabinet at home.
