Buying out of state C&R pistol

OK guys, I haven't seen this come up except indirectly. See if you can confirm/deny what I think I understand. I am a C&R license holder WITHOUT a COE. If I buy a 50 year old C&R hundgun from an OUT OF STATE private party OR from an OUT OF STATE 01 FFL, the transaction must go thru a CA 01 FFL. That seems clear...what is unclear is whether an out of state DEALER must be registered with the CA DOJ. I am assuming that I tell EITHER the out of state FFL OR the out of state private party to simply ship the gun to my CA 01 FFL. Is that correct???

I believe that any firearm that comes from out of state and shipped to a CA 01 FFL dealer must come through a dealer that is registered with the CA DOJ.

Yes, all C&R pistols must be transfered through a CA FFL if shipped into CA.

If shipped in from a private party, they don't have to register with CADOJ in the CFLC program. IF shipped in from an out of state 01FFL, they will need to register in the CFLC program.

If that out-of-state dealer ships the handgun without a CFLC approval, the recieving dealer will probably ship it right back to the sender.

Do you want an AOW or C&R SBS/SBR in CA?

No, it is not required that any incoming fireams shipment be sent from an FFL. A private party may ship to any FFL (however, the FFL may have a personal policy to only accept shipments from other FFLs).

If you go to the Reno show, and your a C&R. You can cash and carry C&R handguns and transport back into Cal, but you have 5 days to submit the proper reg forms + 19$ fee with the DOJ.

If you buy a handgun from anyone and it's shipped, then it has to go through a dealer and dros is required.

How about this twist on the same line of questions: I am an FFL03 / COE holder. I understand that if I go out of state, say AZ or NV, I can buy a C&R handgun, return with it to CA, and file a FD 4100A form with a fee. The question is if I purchase a C&R handgun out of state, can I legally ship (UPS) it to myself in CA at the FFL03 / COE address? I travel frequently for business and would like to purchase in other states, but avoid the inconvenience and issues of checking a handgun as luggage on a commercial airline. Any takers?

Yes, you can ship them back to yourself. You can do this with just the C&R FFL. No need for the COE.

                BATFE FAQ

(B9) May a nonlicensee ship firearms interstate for his or her use in hunting or other lawful activity?

Yes. A person may ship a firearm to himself or herself in care of another person in the State where he or she intends to hunt or engage in any other lawful activity. The package should be addressed to the owner. Persons other than the owner should not open the package and take possession of the firearm.
