    First C&R Purchase

    Hey all,

    So I recently got my FFL03 and COE in the mail and decided to put it in use and acquire a 1916 Spanish Mauser. While trying to get some information I talked to my local gun shop and they gave me some pretty steep warnings about what I do with my FFL03 and that federal regulations are easy to check off while state regulations are much more in depth. I'm supposed to get the gun this week but I'm just curious as to whether or not I'm still within CA limits with this Mauser thats converted to shoot a "modern round". The worker at the store stated that modern ammo and other things may not warrant a C&R in CA regardless of age, I'm not trying to have Marshall's show up at the residence so I just wanted to double check. Also, while I'm here, as far as the purchase goes, I'm just required to bring a copy my FFL3 and COE and I can do a cash and carry since it is an in state transfer correct? I'd just then proceed to fill out a BOF961 or report on CFARS right?

    Congratulations on joining the club. If you're talking about an FR7, you're fine. Those were made in the 50s.

      Guy is clueless and is giving you bull****. 308 is hardly a "modern round" having been introduced in 1952.

      He's probably thinking of sporterizing which will eliminate a rifle's C&R status regardless of when it was sporterized.

        When he was describing it, he stated any jacketed ammunition qualified as modern. I was a bit skeptical too since that would eliminate the vast majority of firearms and render the C&R almost useless.

        Thanks for the welcome. As far as reporting and going about my purchase, I just need to provide a copy of my paperwork to the owner and then submit the form or report on CFARS correct?

            Types of ammunition a weapon can fire has nothing to do with it's classification as a C&R.
            If you are purchasing a C&R from a Gun Shop/01FFL in CA, give them a copy of your 03FFL and COE. The dealer will still fill out a DROS but you will be exempt from the 10 day wait. You do not need to do anything else to report it to the state, that is done by the dealer. All you need to do is enter it in your Bound Book.

                  In that case, yes just provide your 03FFL and COE to the seller and get the sellers info (a copy of CA CDL or ID would be great but at least look at it to confirm the info) and enter the info in your Bound Book. Then send in the BOF-961.

                    If you mean you are trying to buy a C&R long gun from a private party, then you do not get the FFL involved (unless it is being shipped from out of state or a handgun). Just give the seller your paper work, record their name, DL number and address. Enter it all into your bound book and register it on CFARs.

                    I have several copies of my FFL03 and COE on a clip board just waiting for a deal to come my way.

                              Sounds like the gun shop worker was confusing antique with C&R. Some Ca DOJ sources say an antique that uses "modern" ammo has to be DROSd. Martin Retting shop wouldn't sell me a antique G88 rifle with DROS because it shot 8mm Mauser.
                              I think it dates to an old definition from pre '68 GCA text. I could be wrong.
