The spring absolutely has a lip or it at least should have. That lip is what should contact the rim of the next cartridge in the magazine (preventing it from entering the receiver) or if the magazine is empty, the lip should contact the follower. I think you're on it.

I bent the lip further up, and it made the problem worse. I bent it back down and stoned the rough edges just to be sure. The mitigated the problem quite a bit, but did not fix it completely. On one failure, I took it apart to find a round almost all the way onto the feed ramp, but the bullet portion was still stuck in the feed tube opening. Overall, failures were greatly diminished, and when the action did lock up I could make it cycle by either pressing harder on the lever or whacking the side of the receiver with the palm of my hand.

It is definitely a feed issue from the tube through the spring, so I think maybe I have to order a new spring and see if that fixes the problem. I can't think of what else to do.......

In any case, I'm done with it for the night.

I must be getting old - I have two of early 50's 39a's that I haven't touched in a couple of years, really since Chabot closed... anyway I saw this post and figured that I would grab one, open it up and try to figure out what you are talking about only to discover that I can't remember anything about the 39a & 30 minutes before I need to start getting ready for work is probably not the best time to reacquaint myself with it.

if you need pictures of any specific part or as a whole I am more than willing to help & will pull mine apart tomorrow to have a look

If no one here can help further. Go to the Marlinowners forum. There is a guy there that is a absolute genius on these things. Ask there. Probably could find needed parts there also.

Good Luck. I am pretty good, but I need stuff in hand to diagnose. I cannot do it remotely like some can. That does you no good though. Good Luck. Hope you get it going soon.

The is the well known "Marlin Jam". Is it applicable to the model 39a?

I found what is described as a NOS older spring, and ordered it today. Keeping my fingers crossed....

Now, regarding the spacer. I noticed that my spacer has a milled space on one side..... does that go face up or face down in the slot?

Perfect, thanks. I'll let you guys know when the new spring is here and installed, and if it solves my problem.

Actually - I did contact them, and ordered the Cartridge Cut-off Spring. It just arrived today..... they sent me the Cartridge Guide Spring.

I called, and they are sending the right part out today..... I hope.

Popperts, Outback and a place in Texas, that slips my mind right now, are also great for Obsolete Gun Stuff.

Sorry, nothing to add except I've wanted 39a Mountie for years and am now rethinking it given this thread and their current cost.

I'm re-thinking it, too. Supposedly these are fine old lever guns, but this one has had one problem or another since Day 1. On the other hand, I have two Winchester M94/22's that are flawless.

As an aside - this is the second Marlin lever gun that I have owned, the other being a M1893 in 30-30. That one was a POS too, and I sold it off. I'm sticking to Winchesters from now on.
