    Does C&R have to be used?

    Say I have my 03 and coe. I go into a small shop, and the owner has a 1950's handgun in the case. I find out that it is new (never sold), and has been in his store that long.

    Would it be handled as a C&R, or would it have to be transferred as a new firearm, even tho it's over 50 years old?

    If it is new in box but 50 years older or listed on the federal C&R list, it is C&R

    Just like an unsold 1975 car is smog exempt
    C&R nut.

      What shop would have a gun in stock since the 1950's? I do know a gun show vendor that had been bringing a gun to show since I was 15 and I am now in my 40's.

          It is not uncommon to find '70's production Mauser Parabellums new in the box--as well as commemorative handguns from all manufacturers. If they're on the list or over 50 years old, they're C&R.

            Unfortunately, it depends on the shop. There are many who refuse to break their routine and follow the laws which allow for C&R/COE purchases. I've passed on many handguns simply because the shop owner said, "I don't do that," and wanted me to make a return trip in between 10 and 30 days.

              I was just thinking about it.

              A few years ago I was on a road trip to see family. Stopped to have lunch in some little town in Texas. Saw a small gun/taxidermy shop nearby and went in. The old guy that owns the shop had a lot of interesting things for sale, taxidermy wise. Then I saw his display case with handguns. He had some obvious used ones, and a few new ones. He started telling me that he just can't seem to sell this S&W revolver. 38 special, 4 inch blue steel. Maybe a model 10?

              I don't remember how much he was selling it for, but I think it was in the $150-200 range. This was a few years ago. Mid 1980's.

              He told me that he started the business in the 1950's, but didn't start selling guns until the late '50's, and that particular revolver has been in his stock since then.
              I can't remember the name of the town, just that it was northern Texas.

              The owner was probably in his 80's at that time. I doubt the shop is even there anymore.

              I wonder if he ever sold it.

                  I have bought guns that have been in stock and displayed for sale 5-6 or more years. Once I bought a Browning 40 Hi Power in 2004 new in box from a shop that had proof marks indicating it was made in 1995. It was priced cheap maybe they had a lot in stock and just wanted to dump them. It was not a consignment.

                  I have bought guns that have been in a shop so long the price tags have yellowed and curled and faded. A guy I know back east says he has seen price tags that were made with a typewriter. Me and him do tend to hit those little out of the way ancient shops like the taxidermy place mentioned.

                    A California FFL with his crap together will accept your C&R / COE combo.

                    y LGS guy has an original signed (in his presence) copy of my C&R on file...only for idiot FFL's who refuse to accept a package from a non-licensed (-01) FFL.

                    BATFE does not care if the C&R has never been sold, only that it's at least 50 years old (your case) or on the BATFE's list of guns <50 years old. So, you would log the pistol into your bound book, no matter what your FFL wants to do.
