Before they made the claim I am willing to bet Silencerco- whose CEO in case you have not been paying attention, is on the Presidents committee to deregulate suppressors and other NFA items- has done more legal investigation than ANY of the armchair legal eagles spreading thier crap about this.

I'd like to know how he thinks PC 33410 doesn't apply:

33410. Any person, firm, or corporation who within this state possesses a silencer is guilty of a felony and upon conviction thereof shall be punished by imprisonment pursuant to subdivision (h) of Section 1170 or by a fine not to exceed ten thousand dollars ($10,000), or by both that fine and imprisonment.

Unfortunately, PC 16520 only exempts unloaded antique firearms for certain penal codes and as RickD427 pointed out, PC33410 is not included in that list of exemptions for unloaded antique firearms. So, it is even illegal to own or posses in CA. However, if the CEO of SC can clearly show how it is legal, I'll order one asap.
