    Need help ASAP: No longer in possession

    I sold a RIFLE to a calgunner here for $200. I got a copy of his 03FFL and his COE. I sent in a "Notice of no longer in possession" to the BOF but they didn't process it because there was no relevant documentation of the sale such as a sales receipt. I didn't make a sales receipt because I gave the buyer the rifle and he gave me the $200. So what can I do now? Can I send in the buyer's 03 FFL and his COE and call it good? I thought as long as the buyer has these documents the sale is fine.

    Why not send in the FFL03, COE, and print up a simple receipt of sale. You are the seller and normally would be the one to print a sales receipt in most transactions.

    Just a question about the law out there. I assume because all firearms are registered you have to notify when you sell them?

      Try sending the COE and the 03 FFL. And a receipt is something you could make after the fact I'd think, after all receipts are not usually signed by customers.

      Also, the 03FFL buyer should be registering the rifle using the BOF-961 form within 30 days, which would also serve notice to the DOJ that the rifle has transferred hands.

            In fact, not all guns are registered, and there is no requirement that they be registered.

            As it happens, the state has set things up so transfers have to be reported - generally, guns purchased through a CA FFL are reported via the electronic Dealer Record Of Sale (DROS) and intrafamilial transfers and inheritance must be reported by the receivers, and guns moved into CA must be reported/registered. And, C&R purchases must be reported by the buyers.

            In my personal opinion, very few circumstances warrant using the silly No Longer In Possession form.

              I agree. But even if he did register it, I guess I still need supporting documentation. I'll just make a receipt and send in buyer's signed 03 FFL as proof of signature. Also the COE.

                I agree with you. But you can't fight city hall or the CA DOJ BOF.

                  So if you were in possession before the transfer reporting took place you don't need to register? Is that correct? What if you move from another state to CA do you have to register firearms you already own? Or does this fall under firearms moved into the state and the answer is yes?

                            Sucks knowing that many of the laws I read about here are coming soon to NJ. We got a reprieve because the FAT RINO Christie had national ambitions. Now that he is on his way out, and destroying any chance of his Lt Gov Kim Gaudagno of getting elected, soon to be NJ Democrat Governor Murphy has said he will sign all gun control legislation. That's if Christie doesn't sign some himself. He did just sign a bill requiring schools to allow students to use whichever bathroom they identify with that day and faculty to call them by whatever pronoun they wish to be called by on a given day.
