    Santa Clara County Sheriff's C&R Confusion

    I just renewed my C&R, and sent the mandatory letter to my Chief LEO (Sheriff Laurie Smith of Santa Clara County). Nothing out of the ordinary:

    "... informing you that I'm renewing my Curios and Relics, as required by ...."

    Imagine my surprise to get a phone call from a Sheriff's sergeant about the renewal: He thought that I had a FFL 1 (gunshop), not a 3 (Curios & Relics) without the required zoning/business permits.

    I was disappointed at:
    the lack of understanding of what a C&R FFL _is_
    the implication that "many" type 1 FFL's are flouting the rules
    and the queasy feeling I got that the Sheriff's office was more worried about "kitchen table" ffl's than real criminals.

    Note: this is not my 1st C&R renewal, nor my first letter to this Sheriff: I've had one for over a decade (well, I've had 2: I let it expire once before).

    Just FYI.

    lol, Sheriff Laurie Smith is a moron. I don't know why you didn't send it to your local PD instead.

      Most likely his area doesn't have a local police department.

              According to the Santa Clara Sheriff website, Cupertino, Los Altos Hills, and Saratoga all do not have their own police and use the Sheriff as their law enforcement agency.

              If OP does not live in one of those, then yes, I agree he should have sent it to the police chief.

                C'mon, it takes time, money, effort and interest to study and learn about laws and regs.

                And most liberal county sheriffs don't have any of that...thanks overlord laurie.

                    The division commander is Captain Rick Sung, who serves as the Chief of Police for the City of Cupertino.


                    It doesn't matter: I live in unincorporated Santa Clara County: PD is the Sheriff (but I hardly see them), traffic is enforced by CHP, (yes, the sheriff calls CHP instead of handling it themselves).

                    So, like it or not, Santa Clara county sheriff is who I have to contact.

                      Well, I live in a city jurisdiction. I sent a renewal letter to the chief, who called me personally to tell me I was confused and all renewal letters must go to the Sheriff. I advised him I lived in city not county, he told me it's the law that only county sheriff gets renewal letters, not PD chiefs.

                        That is pretty much standard procedure for unincorporated areas of most counties. CHP handles all things vehicle code related.
