School me on C&R pistols shipped to a CA FFL

    School me on C&R pistols shipped to a CA FFL

    Howdy,

    A buddy of mine is considering a specific 50+ year old pistol that he's been unsuccessful in finding here in CA.... and is expanding his search to cover the national for sale boards like gunbroker.
    I'm not well versed in C&R stuff... what are the legalities of a PPT from out of state on a C&R pistol, other than having it shipped to a local FFL for the the transfer?

    Nothings different. If your buddy has a C&R license he/she can take the gun home the same day avoiding the 10 day wait.
    But, it's no different than having a glock or 1911 shipped from out of state.

      Also,remember there are many handguns on The ATF C&R list that are
      NOT 50 years old and are legal to be brought into the state. Pete

        To prevent confusion, you should refrain from using the term "PPT" when referring to any transfer other than an actual PPT. Since this is being shipped from out of state, it's just a standard dealer transfer.

        As to the import of the handgun, if it's over 50 years old it's roster exempt so it should be rather simple, unless he happens upon an FFL that has no clue on the rules. It always amazes me when I ask a local dealer about any of the various rules and they have no clue what we are allowed to do

          There are some C&R guns where you may have an issue establishing that it is in fact C&R eligible. Be sure before he buys it, that it can be established to the dealer's satisfaction that it is.

          Sometimes showing that a gun is over 50 years old, is easier said that done. In some cases it will require research, and be up to the dealer to determine if the source for the information is authoritative. Sometimes all you have to go by is a serial number, and in some cases the only information showing serial numbers relating to year mfgd is a book or worse just a forum post.

          If the gun was manufactured for a while, like a Star Model B Super made from 1946 - 1983, there may be a large population of them that are not 50 years old yet. Will the dealer accept info from a gun forum post to establish that the gun in question is old enough?

            He also needs a CA issued COE (Certificate of Eligibility), in addition to the C&R, in order to bypass the 10 day wait. Otherwise it will be processed as a normal dealer transfer.

              Was just about to say this. Gotta have the C&R plus the COE.

                He doesn't have a C&R, and was mostly concerned about the roster being an issue.

                    That is correct.
                    A FFL03 is basically useless in CA without a COE anyway.

                      Roster is not an issue for C&R eligible pistols. The FFL03 + COE is definitely nice for avoiding that 10 day wait and second trip to the dealer.
