When is C&R not C&R??

O.K. a buddy gave me his 59/66 Yugo. The Feds list as a C&R, Cali doesn't recognize it as C&R unless it's 50 years old. My question is do I enter this into my bound book? I'm assuming yes but I would like some clarification please.

Which kinda sucks cause its got gobs of cosmo and it's gonna take a while to get it all out.

To answer your question - any and all guns that the Federal Government defines as C&R at the time you acquire them must be entered into your bound book. Any firearm that is defined as C&R by the Federal Government when you sell or dispose of it has to be entered as well.

Since it is going through an 01, the best way to keep your book straight is to ask the 01 how he logged it and write that down.

The 01 FFL only counts if you got it from within the state, correct? IOW, if you buy it from an out of state FFL with your C&R you can have it shipped to your home and all is hunky dory?

Yes. If you buy a C&R and it ships through an intermediary FFL, it is my understanding that you want the last log book to be the "acquisition" record. That way if a trace were ever run, they'd go to the 01 who would then have the actual seller. That said, I'd keep the records of the actual seller in the back of my log book too as supplemental info.

California uses the same definition for C&R firearms as the Federal regulations. If the Feds say a firearm is C&R, so does California. You are, like many people, confusing the 50 year C&R dealer transfer exemption with the C&R definition.

When I buy a C&R rifle with my C&R, I log it, right?
But what do I do if it loses C&R status ie I modify it? Just keep it or does it need to be re-registered as a "new" firearm?

When you buy a C&R eligible item as a licensed collector (which you are the day you get your license), you need to log it, whether or not you "use" it.

You don't "register" anything.

EOD Guy had it right the first time. The and means nothing, as anything over 50 years old is automatically C&R.

it means alot in California- where you could have an item , such as an SKS variant (yugo 59/66) that is a CR to the feds, but not to CA DOJ - altering the course of the transaction.

The Yugo SKS is also C&R to CalDOJ.

C&R handguns are C&R to CalDOJ.

Everything that the Feds say is C&R is also C&R to CalDOJ!!!

Just because you can't have it shipped to your door in California doesn't mean it is not C&R to CalDOJ. When CalDOJ says you can't have a Yugo SKS or C&R handgun shipped to your door, it's not because they don't consider the gun to be C&R. It's because they don't consider the gun to be a long gun that is over 50 years old.
