    C&R question

    Can anyone give me a brief overview on what exactly a Curio and Relics license allows me to buy? Is there a certain time period/year of gun or gun model that the license would allow me to buy? Can I as a 18 year old buy one and how would I go about it? Is an FFL necessary?

    You have to be at least 21 years old to get a C&R license from BATFE. A C&R license is really a Type 03 FFL and makes you a "licensed collector of curios & relics". Gun dealers have a Type 01 FFL. C&R firearms include any firearm that is over 50 years old and any firearm listed by BATFE on their C&R firearm list.

    As a Californian with a C&R license, you can...

    - have long guns that are at least 50 years old shipped right to your door from out of state.

    - travel out of state and buy C&R long guns and C&R handguns of any age and bring them back home with you to California


    If you get a Certificate of Eligibility from CalDOJ in addition to your C&R license from BATFE then you can also...

    - skip the 10 day waiting period on C&R long guns and C&R handguns that you purchase at a California FFL Dealer.

    - avoid the "one handgun per 30 days" restriction on all handguns (C&R and modern) that you purchase at a California FFL Dealer.

    Since you are not old enough yet to get a C&R license, you will have to purchase C&R firearms the way most people in California do.

    - You can buy C&R long guns of any age at your local gun shop.
    - You can buy C&R long guns that are over 50 years old from other Californians without going through a gun shop.
    - Your parent or grandparent can give you a handgun as a gift if they also live in California.

      Very cool! Thank you for the info! Needless to say I was ignorant of how it worked until now. Its lame I have to be 21 to get it though!

            Hi Jambi29,

            Just to post a clarification regarding what constitues a C&R gun. It is any gun that is over 50 years old and in its original configuration. It does NOT have to be listed in the ATF's C&R list. Here's the direct quote that can be found at the BATF website under the Curios & Relics header:

            "Firearms automatically attain curio or relic (C&R) status when they are 50 years old. Any firearm that is at least 50 years old, and in its original configuration, would qualify as a C&R firearm. It is not necessary for such firearms to be listed in ATF’s C&R list. However, if your C&R item is regulated under the National Firearms Act (NFA) and you desire removal from the provisions of the NFA, you must submit the firearm to the Firearms Technology Branch for evaluation and a formal classification."

              Would my WWII Mauser be illegal in anyway cuz it was sporterized in the 50's or 60's?

                Sporterizing a Mauser is not illegal.

                      Have you ever taken a hair out of your head - put it on a chopping block; and hit it with an axe? Assuming you hit it exactly in the center - is the the hair - half cut? or half-whole?

                      Anyway - what Norman - was trying to say is... the law is actually against the seller of the weapon... not against the buyer.

                      You having a FFL03 - allows the "seller" to not go to jail - if they sell the weapon to you... while you are outside the state of CA... or whatever.

                        In some states, a C&R FFL does allow you to buy C&R guns - It all depends on the laws of the state you are in. Before moving to CA, I lived in OH. I could buy a gun at any gun shop or gun show or import any C&R gun into the state by simply providing the seller with a signed copy of my C&R. There was no requirement to transfer C&R handguns through a dealer (FFL -01), no DROS, no DOJ Certificate of Elgibility, no state gun registration, no hassle. I could have C&R handguns shipped direct to my door...no problem! Those were the days Hey but we have great weather!!
