    C&R shipping question

I'm sending ("selling") my son in Utah a M44 and I'm in California.

We both have a C&R license.

    I'm sending it UPS.

Can I send it to his work place (which is OK with his boss)?

Or must I send it to his address on his license.

Just trying to keep it legal.

it is supposed to be shipped to the address on his license. if it was to come up missing during shipping it might cause a problem if shipped to a different address. just my 2cents.

There is no legal requirement for you to ship it to his licensed premises. We all just do that to cover our behinds when dealing with strangers. Since you know him, you know he is licensed and you know where he works then I can't imagine you'd have any problems shipping it to his work address.

I know all the "dealers" will only ship to the address on the license. That I really understand. And also if you don't know them. You certainly want to know it is going to the right person with the license.

This is a little different as I certainly know him.

That is what I though. I tried to find a requirement in the law on this, but was unable. So I though I'd ask.

In one of their FFL newsletters, BATF stated that there was no legal requirement to ship to an address on the license. They did say however, that it was the shipper's responsibility to know to whom he was shipping and that the person was licensed.

In your case, I see no problem.

As another option you can have the rifle held for pick up at UPS.

I think this one covers it.

                Q. Can an FFL ship a firearm to an address
that is different from the business
                premises address identified on the
                license?

Yes. Neither the GCA nor its implementing
                regulations contain specific provisions,
requiring that an FFL have firearms shipped
to their licensed business premises when
receiving firearms. To that end, an FFL may
lawfully receive firearms at their mailing
address, storage location, or other address
where the licensee intends to ensure safe
and secure receipt of the firearms
                Furthermore,
pursuant to section 922 (b) of the GCA, it is
unlawful to ship a firearm interstate to an
                unlicensed individual.
We encourage that FFLs verify to the best of
their ability that the shipping address is a
valid location where the licensee is prepared
to receive and subsequently possess the
                firearms
                Jack

Do you want an AOW or C&R SBS/SBR in CA?

Usually an FFL is an FFL unless they specifically state otherwise.

While it's true that the above question and answer portion of the ATF newsletter makes repeated references to "business premises", the answer they give also applies to the activities of Licensed Collectors.

The GCA only requires that you ship a firearm to a licensee when shipping to another State. It does not specify that you have to ship to their licensed premises. The GCA further specifies that Licensed Collectors can acquire C&R firearms at any location.
