    CMP rifle purchase requirements

    OK, now I am confused. (but who isn't with CA gun laws)

    I have a FFL03 and a COE which CMP required for purchase of an M1.

    I received my purchase on 2/5 believing all the requirements had been fulfilled.

    I discovered a thread today that referred to the need to submit a curio/relic firearm report for the purchase within 5 days. As I read the curio or relic firearm report submission requirements they say: State Law requires all FFLs holding a type 03 license who obtain curio or relic firearms WHILE OUT OF STATE to report such purchases or acquisitions to the California Department of justice within 5 days of transporting the firearms into California.

    So, I called DOJ, spoke with a representative (who refused to give me her name) who said a dealer out of state would not be permitted to send a firearm directly to my home, that it would have to be sent to an FFL 01 holder. I was under the impression that CMP purchases were exempt from this if the purchaser had an FFL03 and A COE. Is the curio/relic firearm report still required if they ship directly to your door and you weren't out of state when you purchased with the 003 and COE?

    When I asked what could be done she said I might have to send the guns back, and that I could send in the curio/relic firearm report application, but it might be rejected.

    If you had it shipped to your home, you need to file form http://oag.ca.gov/sites/all/files/ag...s/bof_961.pdf?

    I know the form says In State Acquisition, but they consider receiving it at your home "in state".

    You are suppose to do this within 30 of receipt of the C&R.

    Just fill it out and mail it with a $19 check and you shouldn't have any problems.

      Yes, what Trickster said. You've got 30 days (not 5) and yes, now you've got to pay the $19 to register it.

        Also, to clarify a bit for the OP- It's not that CMP purchases are exempt, ALL C&R long gun purchases are still able to be mailed to your home as long as you have a C&R and a COE.

          Is your question about what will happen if you send the form in 5 days late? I wish I knew what advice to give you. I don't see why sending it back would do any good, or make any sense. I would think CA would just have a penalty fee to make more money, but I have no idea.

            Thanks guys, I figured the DOJ chick didn't know what she was talking about, though after the fact, I read the PC sections 27560 and 27590 she referenced and it's all cloudy(on purpose, no doubt). I did send the Curio/Relic Firearm Report not the Instate report since it was technically an out of state purchase and sent my $19 money grab fee with it, just to be safe even though I am 5 days over. Seems like 5 days over would be better than not at all. Should be postmarked today.

              Did you send the BOF 961 that I linked in my post or the BOF 4100A?

              The BOF 4100A is the wrong form and only gives you 5 days to register once the firearm enters the state. For registration purposes, DOJ does not consider receiving a firearm shipped to your home as an Out Of State purchase since you received it in state.

                Unfortunately I sent the 4100A without seeing the difference. Shows the inexperience I have with the FFL 003, just got it in January. Maybe I should send the BOF 91.

                      It use to be that way, now it's just a flat $19.
                      I went on a buying spree and registered 6 at once using 2 forms and paid only $19. No problems

                        Sorry for hijacking the thread, but now a person needs 01 FFL or 03 FFL & COE in order to purchase M1 Garands from the CMP?

                          If you want it shipped to you then yes you would need a 03FFL & COE, otherwise it needs to be shipped to a 01 FFL for transfer and treated just like any other gun purchase.

                            That's a shame since I want another Garand. Didn't know the law change was that drastic. Got my first M1 back in 2012. Thanks!

                              thank goodness you made this thread and replied to it. I was just about to send in form 4100A instead of BOF 961. Although looking at both forms they seem to be nearly identical other than the form numbers and a place to put your COE information!

                              Now what the heck to put for color...
