Entreprise FAL exempt from California AW BAN???

    Entreprise FAL exempt from California AW BAN???

    I have found an Entreprise ABNI FAL in California for sale online. When I asked the owner who would pay the fees to "export" the Rifle from California, he informs me that he has had this rifle in his collection before registration was required and it is exempt, no need to register it, etc. It is a standard FAL with no bullet button, etc. Flash hider, Pistol Grip and 20rd Magazines. Claims local Sheriff approves....

    Last 2 FAL rifles I bought from Cali were registered there as "AW" and the SELLER paid the AW Dealer's "Export" fee...(Approx $150).

    I do not live in California, but I can't say I've ever heard of a FAL being exempt there. Is it possible to be "pre-registration" and exempt???

    I had thought to make an offer, but now I am going to pass, the country is awash in FAL rifles and I simply dont like what I am hearing, but would like to know if he's correct for my future benefit.

    SELLER:
    "I have added your email address to this response because I have had some connection problems with the GA format. To answer your questions, the receiver does contain the ABNI mark. BTW, thanks for asking that question- never new the significance of it. As to the California export fee, I am unaware of any such fee. My prior protocol has been to simply send the firearm to your designated FFL and the FFL would follow the normal procedure of your state. No person has mentioned anything about a transfer fee that is collected by CA. As for price, I would simply make a good offer. Thank you for the inquiry".


    SELLER:
    "Thank you for the feedback. This FAL with semi-auto receiver, is not registered in CA as AW. Prior to selling, I checked with the local Sheriff, discussed my desire to sell out of state [would be problems selling within CA] and the date of my original purchase of the receiver predated the registration requirements. I was not required to and have not registered this FAL in CA. I hope this helps."

    if you not in California, all he has to do is mail it to your FFL for transfer just like you would any other gun you are buying online.

      "Individuals who owned listed assault weapons before the 1989 assault weapons ban went into effect are allowed to keep such firearms; owners were required to register such weapons with the California DOJ by a deadline established in the assault weapons ban legislation."

      It is my understanding he is not in compliance if he never registered...

      Not sure the local sheriff got the full story and wouldnt trust his word.

        he might not be in compliance (which is a whole nother ball of wax), but it does not stop the fact that he could sell it out of state, in fact that would probably be the smartest thing he could do .

          Smartest thing would be to contact a lawyer and arrange to have it surrendered to LE in lieu of criminal charges.


          Penal Code 30600
          (a) Any person who, within this state, manufactures or causes to be manufactured, distributes, transports, or imports into the state, keeps for sale, or offers or exposes for sale, or who gives or lends any assault weapon or any .50 BMG rifle, except as provided by this chapter, is guilty of a felony, and upon conviction shall be punished by imprisonment pursuant to subdivision (h) of Section 1170 for four, six, or eight years.

            He's full of FUD. I have an Entreprise FAL, mine has a fixed mag and is not an aw, his IS.

            Evil features triggered registration even if it wasn't on the list. My local pd had never heard of the aw registration, and I was fingerprinted for registration a week before the deadline. Local LE had no idea.

              Maybe a little off topic, but I would pass on an Entreprise FAL. There is a reason that they are for sale all over the place.

              Research this manufacturer before even attempting to go through all this crap to get a Entreprise gun. You would be much happier and the transaction will go smoother if you just get a DSA from the factory or something else.

                Sure, Entreprise are junk generally. I never personally owned the ABNI made receivers, was the only reason I was interested. ABNI receivers are excellent quality, every bit as good as DSA, ,that's really the only reason it sparked my interest. I have decided to pass for multiple reasons, but I wanted clarification on the law with this rifle as I sometimes buy AW rifles from CALI

                  Never do this. It cost money and then there is a paper trail on you. It sounds like the right thing to do. But now there is record of you .
                  Now I have to wait three years for an incident to get dropped from the system. and that's with a NRA lawyer.
                  Been gone too long. It's been 15 to 20 years since i had to shelf my guns. Those early years sucked.
                  I really miss the good old Pomona Gun Shows.
