"not intended" , but it still can fire at least 1 shot if its chambered, i would hate to see what happens if it is fired while folded, would the BCG fly out the back?

Seems like not much of a big deal firing when folded, but it did manage to mangle some small spring in the mechanism. I defenitely wouldn't make a habit out of shooting it while folded.

You should be able to fire it in the folding position if you have a gas piston gun as it needs no buffer.

That's entirely dependent on the recoil system. Not all gas pistons allow for such functionality.
