Under Ca. law, the AR15 is an assault weapon but a legally registered select fire or FA M16 is not an AW.

Why is that? Is this because you know something he doesnt, or because your think you do? People scoffed at the guys when they started talking about OLL's back in the day too.

        huh?

i was citing the failure of the law to make it difficult to acquire REAL ASSAULT weapon(s) yet they make it misearble to obtain a lower and mandate some fixation of the magazine etc. i mean a registered select fire full auto capable rifle is not considered an assault weapon. an assault weapons ban can't get any more fail than that.

what did you think i was saying?

I wouldn't have been that harsh, but trinydex is basically correct.

Yes, NFA items are not completely banned in CA, and if you were able to jump through the hoops, you could get one. However, one of the hoops that needs to be jumped through is getting a CADOJ permit (unobtainium for normal people).

In order to get a AW, you would need to get a CADOJ AW permit, as of now, just as unobtainium as an MG permit for most people. LEO and .mil personal can get some AW permits issued to them. I haven't heard of any one getting an MG permit that way.

Do you want an AOW or C&R SBS/SBR in CA?

They didn't need to have the AW law make it difficult to acquire a REAL assualt weapon, they were already restricted in CA.

just to be clear, i wasn't trying to be right or critisize anyone about anything. i don't know **** about these aw exceptions or anything like that. i barely know enough to build my oll.

i was just remarking that california feel good gun laws make no sense. i find it incredibly ironic that they can't asault weaponize assault weapons.

but with california's fear and aversion to AW... i just find it remarkable that they'd allow any.

anyway, the way that CSACANNONEER put it initially just illicited a gut wrenching omg fail.

                To be clear.

So, I'm still a little confused. Machine guns have been banned from civilian use since 1934, but I can find videos all day of people shooting FA at ranges across the country. What part of the picture am I missing here?

i think it the guns are either law enforcement, display purposes units for select ffls that can obtain nfa guns, or registered nfa guns. i'm not sure if that covers it all.

re-read what has been posted. Machine guns are NOT banned from civilian use since 1934, but have been severly restricted.

If you live in a state in which MGs can be owned by civilians, you can fill out a form 4, get the CLEO to sign (or do a trust or corp to bypass), pay $200, and have a background check done, you can buy an MG. Be prepared to spend $5,00 at the minimum and the sky is the limit for the maximum.

In a technical sense, I believe it is a big loophole in the AW ban but, I realize that MG permits and/or getting a class III FFL are major hoops. Again, if you are a civilian and can jump through the right hoops, it would be easier to bring select fire guns into the state than it would be to bring certain SA firearms that have been deemed AWs.

As far as possession of a MG being "banned" on a federal level in 1934 or any years. It never happened! Most states still allow civillians to own them. But, there are several requirements that one must meet in order to buy one and keep one.

Why would getting an MG permit be easier than getting an AW permit? Both permits basically follow the same procedure. http://ag.ca.gov/firearms/forms/pdf/FD030DWApp.pdf

Sorry, I miss understood you. I thought you ment that only non-op display guns or NFA weapons in LE arsonals were allowed in Ca. Again, sorry for the misunderstanding.

The Ca. permits may be equally hard to obtain but, I don't know of any Ca AW permits in civilian hands. Yet, since there are NFA collections in private hands, I have to assume that there must be Ca MG permits in civillian hands.
