Folding forward grip question

    Folding forward grip question

    Lets say you have a featureless build. If you installed one of those folding forward grips in the folded position(horizontal not vertical) would it still be construed as a forward grip? Since it is folded up along with the handguard would it be considered part of the (horizontal) handguard? Since CA doesnt have constructive possesion would this fly?.......... I know this has probably been discussed but I couldnt find were to locate it. Dont bash me to much

    P.S. I have not done this... for the record I dont own in any way shape or form any type of forward handgrip.

    California Penal Code Section 12276.1

    (a) Notwithstanding Section 12276, "assault weapon" shall also mean any of the following:
    (1) a semiautomatic, centerfire rifle that has the capacity to accept a detachable magazine and any one of the following:
    (a) pistol grip that protrudes conspicuously beneath the action of the weapon.
    (b) thumbhole stock.
    (c) folding or telescoping stock
    (d) grenade launcher or flare launcher.
    (e) flash suppressor.
    (f) forward pistol grip.

    The following definitions apply to terms used in the identification of assault weapons pursuant to Penal Code section 12276.1:

    (d) "pistol grip that protrudes conspicuously beneath the action of the weapon" means a grip that allows for a pistol style grasp in which the web of the trigger hand (between the thumb and index finger) can be placed below the top exposed portion of the trigger while firing.
    I don't see a definition of (f) forward pistol grip. Given that it is not well defined I would not assume that a folded forward pistol grip would be considered anything other than what it is, folded or not. I think also the fact that it can be deployed to the unfolded position without the use of tools would also make it hard to argue that it is not a forward pistol grip. I'm not a lawyer but this one seems pretty risky to me.
