    Bushmaster question

    So my dad hands me down a bushmaster XM15 complete. He did not register it back when. I go to my local gunshop and buy and install a bullet button and 10 round clip. The shop and other shops tell that I can fill out DOJ paper work, pay fees, and get this registered in my name. They say its an unknown rule since it came from my dad and to take pictures of the revceiver showing the button. Does this sound right or am I asking for trouble? Would really like to do this if I can.

    I believe a gun on the ban list is non-transferrable. I would strip it, use a different lower that's not banned and sell the XM15 in another state (or destroy it).

      12.Can I inherit and keep a registered assault weapon?

      No. Pursuant to California Penal Code section 12285(b), any person who obtains title to a registered assault weapon by bequest or intestate succession shall, within 90 days, render the weapon permanently inoperable, sell the weapon to a licensed gun dealer who has a permit from the Department of Justice to purchase assault weapons, obtain a permit from the Department of Justice to possess assault weapons, or remove the weapon from this state.


      Oh, Now I see it was not registered.....Answer is still no.

      16.If I did not register my assault weapon by the registration deadline, is there any way I can legally keep it?

      No. If you did not register your assault weapon prior to the registration deadline, you must relinquish that assault weapon to a law enforcement agency. Failure to relinquish your unregistered assault weapon could result in arrest and a felony conviction.

        I think there is also rules and or benefits by putting it in a trust.

              All you'd need to to head to a local gun shop, look for a proper receiver, and rebuild the rifle with said receiver in your name after the 10 day wait. AR platforms are great for taking apart and rebuilding. Most anybody can do it.

              ...most anyway.

                Because the rifle was never registered as an "assault weapon" during the open registration period, it needs to be surrendered or destroyed immediately. There is no provision in the law that allows a non-registered banned rifle to be registered at this point. The positive thing is that the lower receiver is considered the actual firearm and is therefor the only part that needs to be destroyed or surrendered. Possession of a banned, non registered weapon is considered a felony and can result in prosecution to whoever possess it (other than certain exempt individuals and agencies).

                Like others have already said, disassemble the lower receiver, destroy or legally dispose of it and buy an OLL through a LGS and rebuild the rifle with a bullet button and the new OLL.

                FYI: Trying to transport the non-registered banned lower to any place other than law enforcement for destruction, is considered felony transport of an illegal assault weapon.
